Licensee Expenses. During the Term, Licensee shall not be responsible for any expenses incurred in connection with Beverage Operations including, but not limited to, all expenses incurred by Licensee to maintain designated personnel at the Hotel pursuant to Section 3.1 hereof.. Licensee shall use the revenues and receipts it collects from Beverage Operations to pay the expenses of Beverage Operations during the Term (including any extension thereof). In the event that the revenues and receipts from Beverage Operations are less than the expenses of Beverage Operations, Lessee shall reimburse Licensee promptly upon demand, for any shortfall. In the event that the revenues and receipts from Beverage Operations exceed the expenses of Beverage Operations, Licensee shall turn over to Lessee the excess promptly at the end of the Term.
Licensee Expenses. 7.1. The Licensee shall maintain the Encroachments in a good and safe state of repair. Such maintenance shall include providing snow removal services, grading, grass cutting and any other necessary works as may be required by the Licensee in order to continue to use and access the Lands for the purpose intended herein, being the use and enjoyment of the Encroachment.
Licensee Expenses. 8.1. The Licensee shall maintain the Lands in a good and safe state of repair. Such maintenance shall include providing snow removal services, repair of pavement, sanding, grading, grass cutting and any other necessary repairs as may be required by the Licensee in order to continue to use the Lands for the purpose intended herein, being the use and enjoyment of the Boathouse and Dock.
Licensee Expenses. Licensee shall be solely responsible for payment of all expenses incurred by Licensee in its performance of this Agreement, including, but not limited to expenses relating to: local marketing and promotion; support and warranty services; travel to or from Informix's premises; bad debts; collection agency's fees; law suits between Licensee and any third party; and all taxes, tariffs and transportation costs identified in Exhibit B of this Agreement.
Licensee Expenses. During the Term, all costs and expenses with respect to Beverage Operations (collectively, “Liquor Facilities Expenses”), including, without limitation, the following expenses, shall be paid out of the Account: (a) the cost of purchasing Alcoholic Beverage Inventory sufficient to replace Alcoholic Beverage Inventory used and consumed in connection with Beverage Operations during the Term, (b) fees payable to governmental agencies during the Term to keep the Liquor Licenses in full force and effect, (c) all wages, salaries and other commercially reasonable compensation and benefits paid to Beverage Employees, and (d) the premiums for the insurance policies required to be maintained under this Agreement. Notwithstanding anything to the contrary herein, in the event that Liquor Facilities Expenses exceed the amount in the Account at any given time, Owner and Tenant shall be responsible for the payment of such Liquor Facilities Expenses.
Licensee Expenses. Licensee shall not be responsible for any expenses arising from or relating to the operation of the Restaurants from and after the date hereof. Management Company shall, as a part of its services, timely pay all expenses incurred in operating the Restaurants and may apply the Gross Revenues and Receipts to pay all such expenses. Notwithstanding anything to the contrary contained herein, Management Company will only be entitled to a management fee to the extent any Gross Revenues and Receipts are left over after payment of the expenses described in this Section 2.2 and Management Company agrees that it will have no recourse against Licensee or any of the funds of Licensee to pay a management fee.
Licensee Expenses. 5.5.1 Except as expressly required to be provided by or paid by the Licensor under the terms of this Agreement (including pursuant to Sections 5.2, 6.1 and 6.2), the Licensee shall be responsible for all Licensee Expenses. For purposes of this Agreement, “Licensee Expenses” shall mean all costs and expenses (a) actually incurred by the Licensor or the Licensee that are directly attributable to the Licensee’s use of the Arena for a specific Licensee Event pursuant to Sections 6.3 and 6.4 and the proviso in Section
Licensee Expenses. 9.1. The Licensee shall maintain the Lands in a good and safe state of repair. Such maintenance shall include grass cutting and any other necessary repairs as may be required by the Licensee in order to continue to use the Lands for the purpose intended herein, being the use and enjoyment of the Parking Spaces.
Licensee Expenses. Licensee shall not be responsible for any expenses, obligations or liabilities arising from or relating to the Beverage Operations from and after the date hereof. Manager shall, as a part of its services under this Agreement, in a timely manner pay all expenses, incurred in operating the Beverage Operations, including but not limited to, any and all taxes associated with the Beverage Operations, from the revenues and receipts Manager collects. In the event that expenses exceed revenues and receipts, Manager shall have the obligation or liability for such shortfall, and Licensee shall have no obligation or liability for the shortfall.
Licensee Expenses a) Costs and expenses incurred by the Licensee relating to marketing, distribution, promotion, and advertising of the Licensed Technology, or any other costs not agreed upon specifically in writing, shall be the express responsibility of the Licensee.
