Common use of Limitations on File Clause in Contracts

Limitations on File. Material placed in the personnel file of an employee without conforming with the provisions of this Article will not be used by the City in any disciplinary proceeding involving the employee. However, nothing in this Article will prevent the City from maintaining a working file for the purposes of evaluation or investigation. No portion of an employee's file will be transmitted without the explicit consent and request of the employee other than to those authorized within the City as defined in Section B.

However, nothing in this Article will shall prevent the City from maintaining a working file for the purposes of evaluation or investigation. No portion of an employee's file will shall be transmitted without the explicit consent and request of the employee other than to those authorized within the City as defined in Section B.B. The contents of the working file, as those contents relate to that evaluation period, shall be destroyed upon completion of the employee’s annual evaluation.
