LIQUIDATED DAMAGES FOR LATE PAYMENT. If you do not pay your account in full on receipt of your monthly statement, you are in default. Therefore, you acknowledge that we may suspend or cancel your charge privileges, and you agree that we shall be entitled to charge you liquidated damages as follows:
(i) lf we do not receive full payment of the “Total due” billed on your monthly statement by the date of your next statement, the unpaid balance will be identified on that next statement as the “Overdue” amount.
(ii) Liquidated damages of three point three percent (3.3%) (subject to a minimum of HK$100) will be charged on any Overdue amount which is identified in a statement and will be billed in that statement. The Overdue amount may include any unpaid liquidated damages billed on previous statements. We may take such action as we consider necessary to recover overdue amounts and otherwise protect our interests, including the use of debt collection agencies. You will reimburse us for our reasonable costs and expenses of such action, including legal fees.
LIQUIDATED DAMAGES FOR LATE PAYMENT. A. In the event Producer fails to make timely payment, as herein provided, the following cumulative liquidated damage payments shall be due and payable to the principal performer for each day beginning with the day following the date of default: $3.60 per day up to 25 days (excluding Saturdays, Sundays and holidays which Producer observes) up to a maximum of $90.00. Thereafter, the liquidated damages payment shall cease unless either the Union or the principal performer gives written notice to Producer of nonpayment. In the event such notice is given and full payment, including accrued liquidated damages, is not made within 12 working days thereafter, the Producer shall be liable for an immediate additional liquidated damages payment of $90.00 plus further liquidated damage payments at the rate of $10.00 per day from the date of the receipt of notice of nonpayment, which shall continue without limitation as to time until the delinquent payment together with all liquidated damages are fully paid. Such liquidated damages shall be in addition to any and all other remedies which the Union may have against Producer under this Contract. The liquidated damages herein provided shall not be invoked if the principal performer is at fault for failure to execute his/her W-4 Form or other required tax forms or if the principal performer, having been furnished an engagement contract on or before the date of employment, fails to return the signed contract promptly, or when there is a bona fide dispute as to compensation.
B. In the event of a claim, any undisputed sums due and payable to principal performer shall nevertheless be paid within the time periods specified in Section 44, Payment. Failure to make timely payment shall activate the liquidated damages provisions hereof.
C. Liquidated damages for late payment shall accrue commencing 12 business days after the settlement of a disputed claim.
D. In the event Producer fails to make timely payments as required hereunder, the Union may, by written notice, require the payment of session fees, use fees and other fees to be sent to principal performers in care of a designated SAG-AFTRA office.
E. The liquidated damage payments set forth in subsection A shall increase by the same percentage as any agreed-upon wage increase applicable to Section 20, Minimum Compensation, in future negotiations.

In the event Producer/Advertising Agency fails to make timely payments, as herein provided, cumulative penalty payments shall be due and payable to the Performer for each day, beginning with the day following the date of default. The provisions of the applicable Commercials Contract(s) regarding liquidated damages for late payment are deemed to be incorporated herein and made a part of the local commercial code.
LIQUIDATED DAMAGES FOR LATE PAYMENT. Payment shall be made to the performer not later than thirty (30) calendar days following the date or dates of employment. In the event the Company fails to make timely payment as herein provided, the following cumulative liquidated damages payments shall be due and payable to the performer for each day, beginning with the day following the date of default, at four dollars ($4.00) per day and shall continue without limitation as to time until the delinquent payment, together with all liquidated damages, are fully paid. Such liquated damages shall be in addition to any and all other remedies which SAG-AFTRA may have against the Company under this Agreement.
LIQUIDATED DAMAGES FOR LATE PAYMENT. If Employer or its designated payroll provider fails to make timely payment pursuant to Section
A. “Time and Method for Payments”, Employer shall pay to each affected Performer a late-payment penalty for each day, beginning with the day following the day of default: Three Dollars and Fifty Cents ($3.50) for each day’s delinquency up to thirty (30) days (excluding Saturday, Sunday, and holidays which the Employer observes). Thereafter, liquidated damages if either SAG-AFTRA or the Performer gives written notice (email permissible) to the designated representative of the Employer of the nonpayment and full payment including accrued liquidated damages is not made within twelve (12) working days thereafter, the Employer shall immediately pay an additional amount of One Hundred Fifty Dollars ($150.00) plus further liquidated damages payments at the rate of Five Dollars ($5.00) per day from the date the Employer receives, or is deemed to have received, notice of non-payment, which shall continue without limitation as to time until the delinquent payment together with all liquidated damages are fully paid. The late payment penalties set forth in this section shall be in addition to any and all other remedies which SAG-AFTRA or the Performer may have against Employer under this Agreement. The above cumulative payments shall not apply if: SAMPLE ● A bona fide dispute exists as to the amount due and Employer has given SAG-AFTRA prompt written notice of the dispute; ● A Force Majeure event (as the term is generally understood) causes the delay in payment; or ● Where the performer has failed to furnish to the Employer all legally required tax and immigration forms that have been provided to the performer by Employer or its designated payroll house; ● Where the Performer, having been furnished their contract before the day of their performance, fails to return the signed engagement contract promptly.
LIQUIDATED DAMAGES FOR LATE PAYMENT. Time is of the essence. Printer and Customer agree that the failure to pay when due the amounts specified herein shall constitute a material breach of this contract and that it would be impractical and uneconomical to attempt to determine Printer's damages in any legal proceeding. Both parties further agree that the fixing of Printer's damages as provided herein is the most reasonable means to minimize costs and maintain an ongoing commercial relationship, and that the liquidated damages specified below represent a reasonable estimate of Printer's loss by reason of breach by Customer. Customer shall therefore pay Printer on demand as liquidated damages upon such breach (i) an amount equal to 1 1/2 percent per month of the amount of the overdue payment, prorated on a daily basis for each day that payment is overdue, or (ii) the maximum amount that may be charged under applicable law, whichever is less. Printer's right to payment of such damages shall not relieve Customer of its obligation to pay the overdue amounts stated in the invoice when due, or be deemed a waiver of forebearance by Printer of its right to such payment.

Thereafter, the Liquidated Damages payment shall cease unless either SAG-AFTRA or the Performer gives written notice to the Employer of the non-payment. In the event such notice is given and full payment including the Liquidated Damages is not made within twelve (12) working days thereafter, the Employer shall be liable for an immediate Liquidated Damages payment of Seventy-Five Dollars ($75.00) plus further Liquidated Damage payments at the rate of Five Dollars ($5.00) per day from the date of receipt of the notice of non-payment which shall continue without limitation as to time until the delinquent payment together with all Liquidated Damages are fully paid.
