Sundays and Holidays. Shift workers on continuous shifts for work on a rostered shift the major portion of which is performed on a Sunday of holidays shall be paid as follows: 20.10.1 Sundays - at the rate of double time. 20.10.2 Holidays as prescribed by clause 19 Holidays and Sunday Work - at the rate of double time. Shift workers, other than continuous work, for all time worked on a Sunday or holidays shall be paid at the rates prescribed by clause 19- Holidays and Sunday Work, of this Agreement. Where shifts commence between 11.00pm and midnight on a Sunday or holidays, the time so worked before midnight shall not entitle the Employee to the Sunday or holiday rate. Provided that the time worked by an Employee on a shift commencing before midnight on the day preceding a Sunday or holiday and extending into a Sunday or holiday shall be regarded as time worked on such Sunday or holiday. Where shifts fall partly on a holiday, that shift, the major portion of which falls on a holiday, shall be regarded as the holiday shift.

Sundays and Holidays a) Work performed on Sundays and Holidays will be paid at double (2x) the regular rate of pay. Holidays recognized by this Agreement are New Year’s Day, Memorial Day, Fourth of July, Labor Day, Thanksgiving Day and Christmas Day. (No work shall be performed on Labor Day except to save life or property). On a jobsite where another craft employed by the same contractor has the day after Thanksgiving, the Laborers will be granted the same Holiday.
Sundays and Holidays. 9.42.01 All workers shall be paid at the rate of time and one-half (1.5) for all work performed between 8:00 a.m. Sunday and 8:00 a.m. Monday, also for all work performed on those days designated elsewhere in this agreement as recognized Statutory Holidays. 9.42.02 However, double time will be paid to all employees who work beyond eight (8) hours on Sunday and/or Statutory Holidays. The Statutory Holidays will be those referred to in 31.01. 9.42.03 For those employees who would be scheduled to work on Statutory Holiday, holiday pay will be based on each employee’s normal schedule (8 or 12 hour shifts). Those employees not scheduled to work will receive pay as defined in Section 31 - STATUTORY HOLIDAYS.
Sundays and Holidays. Except as otherwise provided, no bargaining unit member will be required to work on Sundays or Holidays. For all bargaining unit members who are scheduled to work 40 hours per week, any work performed on Sundays or holidays and all work performed over and above the forty (40) hour work week shall be compensated at the rate of one and one-half (1-1/2) times his/her normal rate of pay. For all bargaining unit members who are scheduled to work less than 40 hours per week, any work performed on holidays shall be compensated at the rate of one and one-half (1-1/2) times their normal rate of pay. Payment at time and one-half for Sundays would not occur unless their total hours of work for that week exceed 40. The Board and Administration may grant compensatory time off, at the bargaining unit member’s option, in place of overtime pay, at the rate of time and one-half (1-1/2).

In jurisdictions where the majority of the other crafts have Veteran’s Day or the Day after Thanksgiving or any other holiday in their Contracts, the Laborers will be granted the same holiday. Where any of the herein mentioned Holidays fall on Sunday, the following Monday will be observed as the Holiday. Where any of the herein mentioned Holidays fall on Saturday, the preceding Friday will be observed as the Holiday.

(ii) Payment for any holiday need not be made in cases where an employee is absent on the last working day prior to the holiday or on the first working day following the holiday unless such absence is due to illness or the action of the employer or is taken with the permission of the employer. (iii) No employee, other than a shift worker, shall be required to work on a Sunday or holiday unless given forty-eight hours' notice that he will be required. (iv) An employee discharged, except for misconduct, within fourteen days of any of the holidays specified in paragraph (a) of subclause (i) of this clause, shall be paid for such holiday; provided that such employee has been employed for a period of not less than fourteen days immediately prior to the date of his discharge. (v) A holiday shall commence at 7.00 a.m. on the day of the holiday and end at 7.00 a.m. on the next succeeding day. Alternatively, a holiday shall commence at the beginning of the first shift on the day of the holiday and end at the beginning of the first shift on the next succeeding day. The provision of this sub-clause shall not apply to the Australasian Conference Association Limited at Cooranbong and Lewisham.
