Lost or Stolen Bicycle. If User maintains possession of the Garden Communities Bike Share bicycle beyond a period of 24 consecutive hours, then the Garden Communities Bike Share bicycle is deemed lost or stolen, User's credit or debit card will be charged a fee of $1,000, and a police report may be filed with local authorities. The data generated by the Service's computer is conclusive evidence of the period of use of a Garden Communities Bike Share bicycle by a User. For any disappearance of a Garden Communities Bike Share bicycle where a User is held responsible, User must report the disappearance to Garden Communities within 24 hours following the disappearance and must report the disappearance to the local police department within 48 hours. Any use that exceeds a period of 24 consecutive hours is deemed a disappearance of the Garden Communities Bike Share bicycle, until the Garden Communities Bike Share bicycle is found or returned to an eLocker.

Lost or Stolen Bicycle. If User maintains possession of the Provider bicycle beyond a period of 24 consecutive hours, then the Provider bicycle is deemed lost or stolen, User's credit or debit card will be charged a fee equal to the replacement cost of the bicycle and a police report may be filed with local authorities. The data generated by the Service's computer is conclusive evidence of the period of use of a Provider bicycle by a User. For any disappearance of a Provider bicycle where a User is held responsible, User must report the disappearance to Provider within 24 hours following the disappearance and must report the disappearance to the local police department within 48 hours. Any use that exceeds a period of 24 consecutive hours is deemed a disappearance of the Provider bicycle, until the Provider bicycle is found or returned to a Bike Dock.
Lost or Stolen Bicycle. If a Bike is not returned within 24 consecutive hours, then the Bike is deemed lost or stolen, Rider’s credit or debit card may be charged a fee of $1,000.00, and a police report may be filed with local authorities. The data generated by the Service’s computer is conclusive evidence of the period of use of a Bike by a Rider. Rider must report Bike disappearance or theft to BTS immediately or as soon as possible. Rider must report disappearance or theft to the Philadelphia Police Department within 24 hours. BTS will consider timely reporting of a stolen or lost Bike when assessing any cost associated with Rider’s responsibility for the Bike.

  • Lost or Stolen Cards You must tell us immediately by telephone or in writing if you know or suspect that a Card is lost or stolen, or if you know or suspect that your Card or the Account is being used without your authority. Once you have told us that your Card or Account is lost, stolen or used without your authority, we will be able to prevent use of that Card and the Account number.

  • Lost or Stolen Card Except as otherwise stated herein, you are responsible for all transactions initiated through the use of your Card, including any PIN-based transactions, any transactions initiated by presenting the Card Number only and any authorized transactions initiated by someone else. If you believe your Card or Access Information has been lost or stolen, call the number or write to the address listed in the “Contact Information” section below. You should also call the number or write to the address listed in the “Contact Information” section below if you believe a transaction has been made using the information from your Card or Access Information without your permission. You also agree to cooperate completely with the Servicer in attempts to recover funds from unauthorized users and to assist in their prosecution.

  • Recovery of lost or stolen card If the lost or stolen card is recovered, you must immediately return to us the card cut in half without using it. You must not use the PIN and/or the TBS Access Code after reporting to us that the PIN and/or the TBS Access Code has been disclosed to a third party.

  • LOST, STOLEN OR DAMAGED CARDS If the Cardmember loses the Card or if the Card is damaged or stolen or if the PIN became available to any other persons, the Cardmember must immediately inform AEME by telephone. In addition, the Cardmember shall provide AEME with a written notification within 3 days from the date of the occurrence of any of the above listed events, as per applicable laws. All notices pursuant to this article must be sent to the following address: AMEX (Middle East) B.S.C. (c), P.O. Box 5990, Manama, Kingdom of Bahrain. Or facsimile number: (+000) 00 000000. To inform AEME by phone, call the number indicated in the Cardmember Additional Information Leaflet. If AEME is duly informed in the manner described above the Cardmember shall not be liable for any Charges made on his or her Card by any third parties after the Card has been reported lost or stolen. Failure to comply with the provisions of this article will render the Cardmember liable for all Transactions made on his or her lost or stolen Card until the time the Card is reported as lost or stolen to AEME. However, the Cardmember shall at all times be fully liable for all Charges including Cash Withdrawals even if these Charges were made by third parties if these third parties gained possession of the Card or any Supplementary Card or the PIN with the knowledge, permission, approval or other acts of the Cardmember or any Supplementary Cardmember or because of their negligence. If the Card is found after it was reported lost or stolen, the Cardmember may not use or attempt to use the Card at issue and shall immediately inform AEME which will take the appropriate action.

  • No Consequential Damages Other than the Liquidated Damages heretofore described and the indemnity obligations set forth in Article 18.1, in no event shall any Party be liable under any provision of this Agreement for any losses, damages, costs or expenses for any special, indirect, incidental, consequential, or punitive damages, including but not limited to loss of profit or revenue, loss of the use of equipment, cost of capital, cost of temporary equipment or services, whether based in whole or in part in contract, in tort, including negligence, strict liability, or any other theory of liability; provided, however, that damages for which a Party may be liable to another Party under separate agreement will not be considered to be special, indirect, incidental, or consequential damages hereunder.
