Major Maintenance Plan. Not later than December 31, 2020 and not later than December 31 of each year thereafter, the Borrower shall submit the Major Maintenance Plan to the Collateral Agent. The Borrower will provide a copy to the Issuer upon written request of the Issuer.

Major Maintenance Plan. The Issuer shall include in each Annual ---------------------- Operating Budget a re-assessment of (i) the anticipated scheduling and probable cost of Major Maintenance Expenditures for such year, and (ii) the Major Maintenance Reserve Requirement. The Major Maintenance Reserve Requirement shall be modified in accordance with Section 3.7 of the Deposit and Disbursement ----------- Agreement.
Major Maintenance Plan. The Partnership shall include in each Annual Operating Budget a reassessment of (i) the anticipated scheduling and probable cost of Major Maintenance Expenditures for such year (taking into account such anticipated Major Maintenance Expenditures as are covered by the Parts Agreement so long as same shall be in full force and effect), and (ii) the Major Maintenance Reserve Requirement. The Major Maintenance Reserve Requirement shall be modified in accordance with Section 3.5 of the Common Agreement.
Major Maintenance Plan. No later than the Commercial Operation Date and ninety (90) days before the beginning of each Reporting Year after the Commercial Operation Date, the Concessionaire will prepare and deliver to the Authority a full five (5) Reporting Year period maintenance plan on a rolling basis that describes life cycle asset maintenance for the Plant (each, a Major Maintenance Plan) in accordance with Standard Industry Practice, applicable recommendations and instructions of the equipment manufacturers and the Technical Standards. The Major Maintenance Plan will include a description of all Major Maintenance to be undertaken during such five (5) Reporting Year period, by component, item or discrete project the estimated costs and timing relating to each such component, item or project, the underlying assumptions used to develop such plan, including assumptions arising from the re-evaluations of the physical condition of the Plant conducted pursuant to Section 7.3(c).

  • Software Maintenance Subrecipient shall apply security patches and upgrades in a timely manner and keep virus software up-to-date on all systems on which State data may be stored or accessed.

  • Use; Maintenance Borrower shall keep and maintain all items of equipment and other similar types of personal property that form any significant portion or portions of the Collateral in good operating condition and repair and shall make all necessary replacements thereof and renewals thereto so that the value and operating efficiency thereof shall at all times be maintained and preserved. Borrower shall not permit any such material item of Collateral to become a fixture to real estate or an accession to other personal property, without the prior written consent of Lender. Borrower shall not permit any such material item of Collateral to be operated or maintained in violation of any applicable law, statute, rule or regulation. With respect to items of leased equipment (to the extent Lender has any security interest in any residual Borrower’s interest in such equipment under the lease), Borrower shall keep, maintain, repair, replace and operate such leased equipment in accordance with the terms of the applicable lease.

  • Deferred Maintenance Borrower shall, within six (6) months of the date hereof, perform the deferred maintenance work (the “Deferred Maintenance”) to the Property itemized on Exhibit B hereto. Furthermore, Borrowers shall diligently perform, or cause to be performed, in a timely and workmanlike manner all repairs and maintenance contemplated by and itemized in the Approved Budget.

Performance of maintenance, preventive maintenance or inspection shall not be delayed or postponed for the purpose of scheduling the Aircraft unless such maintenance or inspection can safely be conducted at a later time in compliance with applicable laws, regulations and requirements, and such delay or postponement is consistent with the sound discretion of the pilot-in-command. In the event that any non-standard maintenance is required during the term and will interfere with User’s requested or scheduled flights, Operator, or Operator’s pilot-in-command, shall notify User of the maintenance required, the effect on the ability to comply with User’s requested or scheduled flights and the manner in which the parties will proceed with the performance of such maintenance and conduct of such flight(s). In no event shall Operator be liable to User or any other person for loss, injury or damage occasioned by the delay or failure to furnish the Aircraft under this Agreement, whether or not maintenance-related.
