Common use of Managing official (Art Clause in Contracts

Managing official (Art. 11) The contractor will be notified of the identity of the managing official in the contract award notification letter. Once the contract is concluded, the managing official is the main contact point for the service provider. Any correspondence or any questions with regards to the performance of the contract will be addressed to him/her, unless explicitly mentioned otherwise in these Tender Specifications. The managing official is responsible for the follow-up of the performance of the contract. The managing official is fully competent for the follow-up of the satisfactory performance of the contract, including issuing service orders, drawing up reports and states of affairs, approving the services, progress reports and reviews. He or she may order any modifications to the contract with regards to its object and that remain in its scope. However, the following are not part of the competence of the managing official: The signing of order forms (which remains the prerogative of the Resident Representative – see point 3.9), the signing of amendments or any other decision or agreement implying derogation from the essential clauses and conditions of the contract. For such decisions the contracting authority is represented as stipulated under point "The contracting authority". Under no circumstances is the managing official allowed to modify the terms and conditions of the contract, even if the financial impact is nil or negative. Any commitment, change or agreement that deviates from the conditions in the Tender Specifications and that has not been notified by the contracting authority, will be considered null and void.
