Maximum Refund Total. The total of all refunds under this Right of Entry shall not exceed the Maximum Refund Total, which is the sum of the maximum refunds available for each Harvest Area identified in Section 2.1.

Maximum Refund Total. In no event shall the total of all refunds issued to Purchaser under Section 11 of this contract exceed the Maximum Refund Total. The Maximum Refund Total shall be the dollar amount of the Bonus Bid divided by the total poundage of geoduck in the Harvest Ceiling and multiplied by the poundage of geoduck in the Harvest Ceiling that Purchaser has not harvested. In the event that Purchaser has made any payments, other than the Bonus Bid, to DNR for geoduck that Purchaser has not yet harvested under this contract, the dollar amounts of such payments shall be added to the dollar amount identified in the preceding sentence to calculate the Maximum Refund Total. If the total amount of all refunds to Purchaser under Section 11 of this Contract exceeds the Maximum Refund Total, Purchaser must return to DNR all refunded amounts in excess of the Maximum Refund Total within thirty (30) days of receiving any such excess payments.

If the employee meets the skills and abilities requirements of the position and chooses to remain in the reallocated position, the employee retains existing appointment status and has the right to be placed on the Employer’s internal layoff list for the classification occupied prior to the reallocation.
