Memorandum of Contract. At the request of any party hereto, a Memorandum of this Agreement shall be recorded in the recording offices of each and every County in which the Timberlands are located.
Memorandum of Contract. Upon request of either party, the parties shall execute a memorandum of contract in recordable form setting forth such provisions hereof (other than the Purchase Price and other sums due) as either party may wish to incorporate. Such memorandum of contract shall contain a statement that it automatically terminates and the property is released from any effect thereby as of a specific date to be stated in the memorandum (which specific date shall be no later than the Closing Date). The cost of recording such memorandum of contract shall be borne by the party requesting same.

If Buyer records a memorandum of contract, Buyer shall furnish a notice of termination that Seller can record.

Purchaser covenants and agrees that in no event will Purchaser record or cause to be recorded this Agreement or any memorandum hereof and that Purchaser’s breach of this provision shall represent a default of the nature governed by Section 16(a) hereof and Seller shall have all of the rights and remedies provided under Section 16(a) hereof, including, without limitation, the option of terminating this Agreement and retaining the Deposit as liquidated damages.
