Motor Carriage. RLS will not use any Motor Carrier with an “unsatisfactory” safety rating. RLS will require proof of insurance and operating authority from each Motor Carrier engaged by it. RLS agrees to enter into Broker-Carrier contracts with its Motor Carriers that comply with all applicable federal and state regulations and will include the following provisions:

Motor Carriage. BROKER represents that it shall require the following terms for each underlying Carrier it utilizes in the performance of these Terms: A. Carrier shall comply with all applicable federal and state laws and regulations and shall expressly waive any and all rights and remedies under Subtitle IV, Part B of 49 U.S.C. (as allowed by § 14101) to the extent such rights and remedies conflict with the terms and conditions of these Terms. B. Motor Carrier shall agree that its liability for cargo loss or damage shall be determined by 49 USC § 14706 (the Xxxxxxx Amendment), subject to a maximum liability of $100,000 per bill of lading per occurrence, Carriers’ applicable tariffs or policy terms/exclusions, and to Section 7 of these Terms. C. Carrier shall agree to maintain, at all times during the transportation of the shipment that is the subject of the Agreement delivered to SHIPPER with these Terms, insurance coverage with limits not less than the following: i. Commercial Automobile Insurance coverage with limits of not less than $1,000,000 per occurrence; ii. Motor Truck Cargo Insurance in an amount of $100,000 shipment; iii. Statutory Worker’s Compensation X. Xxxxxxx shall at all times during the transportation of the shipment that is the subject of the Agreement delivered to SHIPPER with these Terms not have an “Unsatisfactory” safety rating as determined by FMCSA or any state authority with jurisdiction over its operations. E. Carrier shall process all claims for loss, damage, or delay to SHIPPER’s freight in accordance with the provisions of 49 C.F.R. Part 370, regardless of whether such regulations would otherwise apply.

  • Prescription Glasses This plan covers prescription glasses as follows: • Frames - one (1) collection frame per plan year; • Lenses - one (1) pair of glass or plastic collection lenses per plan year. This includes single vision, bifocal, trifocal, lenticular, and standard progressive lenses. This plan also covers the evaluation, fitting, or follow-up care related to contact lenses. This plan covers additional contact lenses if your prescribing network provider submits a verification form, with the regular claim form, verifying that you have one of the following conditions: • anisometropia of 3D in meridian powers; • high ametropia exceeding -10D or +10D in meridian powers; • keratoconus when the member’s vision is not correctable to 20/25 in either or both eyes using standard spectacle lenses; and • vision improvement for members whose vision can be corrected two lines of improvement on the visual acuity chart when compared to the best corrected standard spectacle lenses.

  • TOOL STORAGE 1. A company shall provide on all construction jobs in towns and cities, and elsewhere where reasonably necessary and practicable (or if requested buy the employee), a suitable and secure waterproof lock-up solely for the purpose of storing employees’ tools, and on multi-storey and major projects the company shall provide, where possible, a suitable lock-up for employees’ tools within a reasonable distance of the work area of large groups of employees. 2. Where an employee is absent from work because of illness or accident and has advised the company in accordance with Clause 33 – Personal Leave of the award, the company shall ensure that the employee’s tools are securely stored during his/her absence.

  • Business Automobile Liability insurance with a combined Bodily Injury/Property Damage limit of not less than $1,000,000 each accident. The policy shall cover liability arising from the operation of licensed vehicles by policyholder.

  • Transporting Students 1. Employees shall not transport students except in accordance with School Board rules. The Board shall adopt a school board policy outlining the teacher’s and the Board’s responsibilities and liabilities. Said policy shall be included in all school handbooks beginning with the 2004-05 school year. 2. Teachers will not be required to transport pupils to and from activities which take place away from the school grounds.

  • Footwear Where an employee is required by the College or by legislation, in order to perform his/her duties, to acquire and wear protective footwear, the employee shall provide the College with proof of purchase by March 1 each year and the College shall reimburse such employee, on the first pay day in April in each year, up to a maximum of one hundred and fifty dollar ($150.00). In situations other than the foregoing, the College may, in its discretion, (which discretion shall not be unreasonably exercised) reimburse such expense where it is recommended by the health and safety committee constituted under the Occupational Health and Safety Act.

  • Company Automobile During the Term, the Company shall provide Executive use of a Company automobile with a lease value of up to One Thousand Five Hundred Dollars and Zero Cents ($1,500.00) per month for Executive’s business or personal use, less any required taxes or withholdings.

  • Durable Medical Equipment Durable Medical Equipment is equipment that is Medically Necessary for treatment of an illness or Accidental Injury or to prevent further deterioration. This equipment is designed for repeated use and used to treat a medical condition or illness, and includes items such as oxygen equipment, functional wheelchairs, and crutches. Durable Medical Equipment may require Prior Authorization. Only Durable Medical Equipment considered standard and/or basic as defined by nationally recognized guidelines are Covered.

  • Television Equipment Recycling Program If this Contract is for the purchase or lease of covered television equipment, then Contractor certifies that it is compliance with Subchapter Z, Chapter 361 of the Texas Health and Safety Code related to the Television Equipment Recycling Program.
