Common use of Network Customer Facilities Clause in Contracts

Network Customer Facilities. The provision of Network Integration Transmission Service shall be conditioned upon the Network Customer’s constructing, maintaining and operating the facilities on its side of each delivery point or interconnection necessary to reliably deliver capacity and energy from the Transmission Provider’s Transmission System to the Network Customer. The Network Customer shall be solely responsible for constructing or installing all facilities on the Network Customer’s side of each such delivery point or interconnection. Notwithstanding the foregoing, this Section 29.4 shall not apply to service to the Transmission Provider’s Native Load Customers.

The Network Customer shall be solely responsible for constructing or installing and operating and maintaining all facilities on the Network Customer’s 's side of each such delivery point or interconnection. Notwithstanding the foregoing, this Section 29.4 shall not apply to service to the Transmission Provider’s Native Load Customers.41.5
