Network Performance Requirements. The Company will meet or exceed the minimum network performance requirements in effect at the relevant time and applicable generally to the NDS ESMR Network operations, provided that the Company will not be penalized for failure to meet such requirements to the extent the average level of performance on such measurements achieved by the NDS during the same relevant period does not exceed the level of the Company's performance. Network performance for the first six months following launch in any service area will not be included in performance measurements for either party. At reasonable times and with advance notice, NWIP, through such representatives as it designates, will have the right to monitor system performance in the Territory in order to determine the Company's compliance with the required standards.

Network Performance Requirements. To maintain the integrity of Nextel's national network and reputation in the marketplace, Manager must meet specific criteria as specified in the Collateral Agreement or JV Agreement related to the performance of the iDEN network and the level of customer satisfaction. Manager will be required to measure and provide periodic reporting of its performance in a format satisfactory to Licensee.
Network Performance Requirements. ‌ (1) The parties acknowledge that: (a) Schedule 5.1 of the Rules sets out various requirements and conditions which the Generator may have to satisfy as a condition of connection of the Generator’s equipment to Essential Energy’s network; and (b) Schedule 5.1 of the Rules permits the parties to agree in this Agreement to vary some of those requirements and conditions.   • Performance Requirements A. There is no guaranteed minimum amount of work which will be ordered under this Contract. B. The total Contract amount will not exceed $4,900,000. C. This is a Contract for work specified in individual Job Orders. Work ordered prior to but not completed by the expiration of the Contract period, and any additional work required as a result of unforeseen conditions encountered during construction up to six (6) months after the contract expiration date, will be completed with all provisions of this Contract still in force.   • Ongoing Performance Measures The Department intends to use performance-reporting tools in order to measure the performance of Contractor(s). These tools will include the Contractor Performance Survey (Exhibit H), to be completed by Customers on a quarterly basis. Such measures will allow the Department to better track Vendor performance through the term of the Contract(s) and ensure that Contractor(s) consistently provide quality services to the State and its Customers.
