Common use of Night rate Clause in Contracts

Night rate. (a) An employee whose normal hours of duty fall between 8pm and 6am will be paid at time ¼ rate in addition to normal salary for all hours which so fall, provided that the minimum payment under this provision shall not be less than payment for two hours at time ¼ rate even if the part of a shift which falls between the hours of 8pm and 6am is less than two hours; Night rate is not to be paid for the same hours as either overtime or penal rates.

Night rate. (ii) Night rate is not to be paid when overtime is being worked. Night rate will not be paid for the same hours as either overtime or work undertaken on a public holiday which attracts other penal rates.

Night rate will not be paid for the same hours as either overtime or work undertaken on a public holiday which attracts other penal rates.
