Overtime and Penal Time. 8.2.1 Eligibility restricted for senior nurses or midwives This clause 8.2 shall apply to all employees except that for Senior Nurses and Senior Midwives, overtime and penal rates will only apply as outlined in 8.2.1 (a) and (b) below: (a) Penal - Payment of weekend and night ‘penal’ rates shall be payable where Senior Nurses/Midwives are required to work shifts and rosters or have approval to work weekends or nights on a regular basis in order to fulfil the requirements of the Job Description. (b) Overtime shall be payable to senior nurses or midwives only in the following circumstances: (i) Where the appropriate manager is satisfied that the additional time worked is necessary because of an emergency or other special circumstances; and (ii) Where the salary does not already incorporate a payment for overtime/penal time hours. Equivalent time off for work performed outside normal hours may be granted in lieu of overtime by agreement between the employee and the manager concerned.

Overtime and Penal Time. 2.2.1 Eligibility restricted for Advanced Clinician/ Advanced Practitioner/ Designated Positions. This clause 2.2 shall apply to all employees except that for Advanced Clinician/ Advanced Practitioner/ Designated Positions, overtime and penal rates will only apply as outlined in 2.2.1 (a) and (b) below: a) Penal - Payment of weekend and night ‘penal’ rates shall be payable where Advanced Clinician/ Advanced Practitioner/ Designated Positions are required to work shifts and rosters or have approval to work weekends or nights on a regular basis in order to fulfil the requirements of the job description. b) Overtime shall be payable to Advanced Clinician/ Advanced Practitioner/ Designated Positions only in the following circumstances: (i) Where the appropriate manager is satisfied that the additional time worked is necessary because of an emergency or other special circumstances; and (ii) Where the salary does not already incorporate a payment for overtime/penal time hours. Overtime and Penal Time. 7.1 The normal hourly rate of pay shall be 1/2086 part, corrected to 3 decimal places of a dollar of the yearly rate of salary payable. 7.2 Equivalent time off in lieu of payment for work performed outside normal hours may be granted by agreement. 7.3 Overtime and penal time shall not be paid in respect of the same hours.
Overtime and Penal Time. Subject to the provisions of penal time (6.2.2), overtime is time worked in excess of 8 hours a day, Monday to Friday inclusive, and all time, other than penal time, worked on a Saturday, Sunday or Whole holiday when such work has been properly authorised.

In lieu of payment for overtime, the employer and employee may jointly agree for the employee to take equivalent (that is, on an hour for hour basis) paid time off work at a mutually convenient time. 7.2 Penal time is defined as time (other than overtime) worked within ordinary hours on a Saturday or Sunday. Penal time shall be paid in addition to normal salary. Penal rates are specified in schedule 4. 7.3 Overtime and penal time shall not be paid in respect of the same hours.

(b) Public Holiday rate – applies to those hours which are worked on the public holiday. This shall be paid at time one (T1) in addition to the ordinary hourly rate of pay. (See the Public Holiday clause for further clarification.) (c) Night rate – Current Clause 6.4 6.3 Overtime and penal time shall not be paid in respect of the same hours.
