NNM Listings. Acquirer shall promptly following the execution of this Agreement prepare and submit to The Nasdaq Stock Market a listing application covering the shares of Acquirer Common Stock (and associated Acquirer Rights) issuable in the Merger and upon exercise of the Company Stock Options, and shall use all commercially reasonable efforts to obtain, prior to the Effective Time, approval for the listing of such Acquirer Common Stock (and associated Acquirer Rights), subject to official notice of issuance.
