No Creation of Encumbrance. During the subsistence of this Agreement, subject to its right to obtain project loan as above, the Promoter shall not create any charge, mortgage, lien and/or shall not sell, transfer, convey and/or enter into any agreement with any person other than the Allottee in respect of the said Apartment, subject to the Allottee fulfilling all terms, conditions and obligations of this Agreement.
No Creation of Encumbrance. The Sellers shall not create any charge, mortgage, lien and/or shall not sell, transfer, convey and/or enter into any agreement with any person other than the Buyer in respect of the Said Unit And Appurtenances, subject to the Buyer fulfilling all terms, conditions and obligations of this Agreement.
No Creation of Encumbrance. The Owners and the Developer shall not create any charge, mortgage, lien and/or shall not sell, transfer, convey and/or enter into any agreement with any person other than the Buyer in respect of the Said Flat And Appurtenances, subject to the Buyer fulfilling all terms, conditions and obligations of this Agreement.
No Creation of Encumbrance. The Transferors hereby guarantee and undertake that the Transferors shall not create any charge, mortgage, and lien and/or shall not sell, transfer, convey and/or enter into any agreement with any person other than the Purchaser in respect of the Unit And Appurtenances, subject to the Purchaser fulfilling all terms, conditions and obligations of this Agreement.
No Creation of Encumbrance the Sellers shall not create any charge, mortgage or lien and/ or shall not sell, transfer, convey and/or enter into any agreement with any person other than the Buyer in respect of the Said Unit And Appurtenances, subject to the Buyer fulfilling all terms, conditions and obligations of this Agreement. This will not prevent the Sellers from taking construction/project finance on the security of the Said Property/receivables/work-in- progress provided it is clarified that at the time of registration and execution of the conveyance of the Said Unit And Appurtenances it shall be the duty of the Sellers to have the Said Unit And Appurtenances free from all encumbrances including the financial institution.
No Creation of Encumbrance. During the subsistence of this Agreement, subject to its right to obtain project loan as above, the Owner/Vendor shall not create any charge, mortgage, lien and/or shall not sell, transfer, convey and/or enter into any agreement with any person other than the Allottee in respect of the said Apartment, subject to the Allottee fulfilling all terms, conditions and obligations of this Agreement. This may however not restrict the Owner/Vendor in creating any charge, mortgage, lien over or in respect of any other apartment or spaces of the Project in terms of the Act or Rules.
No Creation of Encumbrance. During the subsistence of this Agreement, subject to its right to obtain project loan as above, the Promoter shall not create any charge, mortgage, lien and/or shall not sell, transfer, convey and/or enter into any agreement with any person other than the Allottee in respect of the said Apartment, subject to the Allottee fulfilling all terms, conditions and obligations of this Agreement.
1. The Allottee shall use:
a) the provided electric charging stations for alternative fuel vehicles to reduce the pollution due to vehicular transportation.
b) the rainwater harvesting systems to harvest water on-site and conserve water.
c) low flow and efficient water fixtures such as low-flow dual-flush toilets, showers, and sinks to reduce potable water consumption.
d) energy efficient HVAC (Heat Ventilation Air Conditioning) design and lighting design for low power consumption
e) the space for storage and collection of recyclable materials such as dry waste, wet waste, E-Waste, and other kinds of waste.
2. The Allottee shall ensure that it shall not smoke in the said Apartment, the Residential Common areas, Amenities and Facilities and the Project Common areas, Amenities and Facilities except for the spaces specifically designated for smoking, ensuring that Project Orbit Bella is smoke-free, and thereby ensuring the health and safety of all its occupants.
No Creation of Encumbrance. During the subsistence of this Agrement, the Owners and Ideal shall not (subject to Clause 11.1.14), create any charge, mortgage, lien and/or shall not sell, transfer, convey and/or enter into any agreement with any person other than the Buyer in respect of the Said Flat And Appurtenances, subject to the Buyer fulfilling all terms, conditions and obligations under this Agreement.
No Creation of Encumbrance. The Promoter hereby guarantees and undertakes that the Promoter shall not create any charge, mortgage, and lien and/or shall not sell, transfer, convey and/or enter into any agreement with any person other than the Allottee in respect of the Said Unit, subject to the Allottee fulfilling all terms, conditions and obligations of this Agreement.
No Creation of Encumbrance. The Transferor and the Developer shall not create any charge, mortgage, lien and/or shall not transfer and/or enter into any agreement with any person other than the Transferee in respect of the Said Apartment and Appurtenances, subject to the Transferee fulfilling all terms, conditions and obligations of this Agreement.
