Residential Common Areas definition

Residential Common Areas means those parts of the Residential Development intended for the common use and benefit of the Residential Development as a whole and not just any particular Residential Unit or any particular part thereof and which are, subject to the provisions of this Deed, to be used by each Owner and Occupier of the Residential Units in common with all other Owners and Occupiers of the Residential Units which said parts include but not limited to:-
Residential Common Areas. Those parts of the Lot and the Building designed or intended for the common use and benefit of the Owners of the Residential Units and not otherwise specifically assigned to or for the exclusive use of an Owner of a Residential Unit (which do not form part of the Units, Building Common Areas or Car Park Common Areas) and shall include but not limited to the Recreational Areas, Visitors’ Car Parks, loading and unloading spaces, water meter room, electricity meter room, air-conditioning platforms (A/C platforms), air-conditioning plant rooms (A/C plant rooms), telecommunication broadcasting equipment room (TBE room), hose reel (H.R.) cabinet, water meter cabinets (WMC), areas for installation of satellite dishes and/or TV antennae, areas for installation or use of aerial broadcast distribution facilities and telecommunications network facilities, refuse storage and material recovery rooms (RS & MRR), mail delivery area with mailboxes, potable and flushing water tank pump room, lift machine room, transfer plate, pipe xxxxx, lift lobbies including fireman’s lift lobbies, lobbies, toilet lobby, lift shafts, corridors, staircases, lift pit, plant rooms, air ducts, pipe ducts (P.D.)(which do not form part(s) of Residential Units or Building Common Areas), parts of the roof (other than the flat roofs), top roof, canopy, pump rooms, switch rooms, parapet wall, the External Walls of the First Floor and above of the Building, floor slabs (which do not form part of the Units), enclosing walls of the Residential Common Areas (but in the case of such enclosing walls adjoining any Unit(s), excluding the plaster and covering of the internal surface of such enclosing walls within the relevant Unit(s)) and all other common parts specified in Schedule 1 to the Building Management Ordinance (Cap.344) (if any) within the Lot and the Building designed or intended for the common use and benefit of the Owners of the Residential Units and not otherwise specifically assigned to or for the exclusive use of an Owner of a Residential Unit. Residential Common Areas means and includes all those areas of the Development (whether within or outside the Residential Accommodation) as shown on the Basement 2 Floor Plan, the Basement 1 Floor Plan, the Ground Floor Plan, the 1st Floor Plan, the 2nd Floor Plan, the 3rd Floor Plan, the 5th Floor Plan, the 6th - 12th, 15th - 16th, 18th - 23rd & 25th - 29th Floor Plan, the 17th Floor Plan, the 30th Floor Plan, the 31st Floor Plan, the 32nd Floor Plan, the 33rd Floor Plan, the Roof Floor Plan, the Upper Roof 1 Floor Plan and the Elevation 1, 2, 3 & 4 Plans annexed to this Deed and certified as to the accuracy thereof by or on behalf of the Authorized Person and thereon coloured green and green hatched black and intended for the common use and benefit of the Owners and Occupiers of the Residential Units and their bona fide visitors including, but not limited to, the Club House, the lift lobbies on all floors (except the Basement 2 Floor, the Basement 1 Floor, the 1st Floor and the 00xx Xxxxx), the lift shafts, the filtration plant room for swimming pool on 1st Floor, Wider Common Corridors, staircases, exits, ramps, the external walls of the Residential Accommodation, the main entrance on the Ground Floor, the meter room, the water meter cabinet, RS&MMR, the caretaker's counter, planters, the Sky Garden on the 3rd Floor, the refuge floor, the drencher water tank and drencher pump room on 17th Floor, the architectural fins and features, pipes serving the Residential Accommodation, the lift machine room, the potable and flushing water pump rooms, the potable and flushing water tanks and the water tank room on Upper Roof 1 Floor, the fan room, the A/C Platforms not forming part of the Residential Units and any other parts of the Development for the common benefit of the Owners and Occupiers of the Residential Units and their visitors and not for the exclusive use or benefit of the Owner or Occupier of any individual Residential Unit or his visitors EXCLUDING the Estate Common Areas and the Car Park Common Areas and EXCLUDING any part, space, area or facility the exclusive right and privilege to hold use, occupy and enjoy the same that belongs to any particular Owner PROVIDED THAT, where appropriate, if (a) any parts of the Development covered by paragraph (a) of the definition of "common parts" set out in section 2 of the Ordinance and/or (b) any parts specified in the Schedule 1 to the Ordinance and included under paragraph (b) of the definition of "common parts" set out in section 2...

Examples of Residential Common Areas in a sentence

  • The common flat roofs on 2/F of the Development form part of the Residential Common Areas.

  • The relevant areas are commonly classified as "Residential Common Areas" in the context of the deed of mutual covenant of a development.

  • Observe the rules framed from time to time by the Promoter/Association (upon formation) for the beneficial common enjoyment of the Residential Common Areas, Amenities and Facilities and the Project Common Areas, Amenities and Facilities.

Related to Residential Common Areas

  • Common Areas is defined as all areas and facilities outside the Premises and within the exterior boundary line of the Project and interior utility raceways and installations within the Unit that are provided and designated by the Lessor from time to time for the general non-exclusive use of Lessor, Lessee and other tenants of the Project and their respective employees, suppliers, shippers, customers, contractors and invitees, including parking areas, loading and unloading areas, trash areas, roadways, walkways, driveways and landscaped areas.

  • Residential building means a building containing one or more residential dwellings.

  • Common Area means all areas and facilities within the Project that are not designated by Landlord for the exclusive use of Tenant or any other lessee or other occupant of the Project, including the parking areas, access and perimeter roads, pedestrian sidewalks, landscaped areas, trash enclosures, recreation areas and the like.

  • Limited common areas and facilities means those common areas and facilities

  • apartment building means a residential use building, or the residential use portion of a mixed-use building, other than a townhouse or stacked townhouse containing four or more dwelling units each of which shall have access to above grade common halls, stairs, elevators, and yards;

  • Building means any structure used or intended for supporting or sheltering any use or occupancy.

  • Heritage Building means a Building designated under Part IV of the Ontario Heritage Act, R.S.O. 1990, c. O.18, or any successor legislation, or a Building designated under Part V of the Ontario Heritage Act,R.S.O. 1990, c. O.18, or any successor legislation, which has been identified as a significant heritage resource in a conservation district plan and any Building listed in the Markham Register of Property of Cultural Heritage Value of Interest;

  • residential premises means a house, building, structure, shelter, or mobile home, or portion thereof, used as a dwelling, home, residence, or living place by 1 or more human beings. “Residential premises” includes an apartment unit, a boardinghouse, a rooming house, a mobile home, a mobile home space, and a single or multiple family dwelling, but does not include a hotel, a motel, motor home, or other tourist accommodation, when used as a temporary accommodation for guests or tourists, or premises used as the principal place of residence of the owner and rented occasionally during temporary absences including vacation or sabbatical leave.

  • mixed-use building means a building or structure containing a residential and non- residential use other than a home occupation;

  • Residential rental property means property that is used solely as leased or rented property for residential purposes. If the property is a space rental mobile home park, residential rental property includes the rental space that is leased or rented by the owner of that rental space but does not include the mobile home or recreational vehicle that serves as the actual dwelling if the dwelling is owned and occupied by the tenant of the rental space and not by the owner of the rental space.

  • Public building and "public work" means a public building of, and a public work of, a governmental entity (the United States; the District of Columbia; commonwealths, territories, and minor outlying islands of the United States; State and local governments; and multi-State, regional, or interstate entities which have governmental functions). These buildings and works may include, without limitation, bridges, dams, plants, highways, parkways, streets, subways, tunnels, sewers, mains, power lines, pumping stations, heavy generators, railways, airports, terminals, docks, piers, wharves, ways, lighthouses, buoys, jetties, breakwaters, levees, and canals, and the construction, alteration, maintenance, or repair of such buildings and works.

  • Residential Zone means a zone earmarked for buildings exclusively designed for human habitation and in no case shall include its use in whole or a part thereof for any other purpose e.g commercial activities, school, institution, shop, office, clinic, beauty parlor, guest house, marriage center, gymnasium, tuition center, club activities, work-shop, store or godown etc. or for the purpose of political, religious and sectarian activities. It includes parks, gardens, play grounds, sector shops and other open spaces located in the area earmarked in the residential zone.

  • Building Project means the aggregate combined parcel of land on a portion of which are the improvements of which the Premises form a part, with all the improvements thereon, said improvements being a part of the block and lot for tax purposes which are applicable to the aforesaid land.

  • Building site means a plot of land held for building purposes, whether any building is actually erected thereupon or not, and includes the open ground or courtyard enclosed by, or adjacent to, any building erected thereupon;

  • Residential real property means real property improved by a one to four family dwelling used or occupied, or intended to be used or occupied, wholly or partly, as the home or residence of one or more persons, but shall not refer to (a) unimproved real property upon which such dwellings are to be constructed or (b) condominium units or cooperative apartments or (c) property on a homeowners’ association that is not owned in fee simple by the seller.

  • Shopping Center means the Shopping Center identified on the initial page hereof.

  • Garage shall have the meaning ascribed to it in Recital H;
