NO DISCRIMINATION OR COERCION. 3.01 The Employer agrees that there shall be no discrimination or coercion exercised or practiced by it or any of its representatives with respect to any employee because of her/his participation in the Union or in the matter of hiring, rates of pay, employee benefits, training, promotion, transfer, lay-off, recall, discipline, discharge or other terms and conditions of employment by reason of race, creed, colour, age (except for retirement as provided for in the welfare benefits), sex, sexual orientation, marital status, nationality, ancestry, religion, place of origin, or physical disability as per the Ontario Employment Standards Act, the Ontario Human Rights Code, and the Ontario Labour Relations Act. 3.02 Neither the Employer nor the Union, or representatives of either party shall intimidate, interfere with, restrain or use coercion upon employees of the Employer because of membership, activity or inactivity in the Union, or in any labour organization. The Union agrees that there will be no Union activity on University premises except as contemplated by this Agreement.
