The provisions of this Agreement shall be applied equally to all full time employees in the bargaining unit without discrimination as to age, sex, marital status, race, color, creed, national origin, member- ship or non-membership in the Union or political affiliation. The Union shall share equally with the Employer the responsibility for applying this provision of this Agreement.

The failure of the City to apply provisions herein without discrimination shall be subject to the provisions of the grievance procedure. Nothing herein shall interfere with the City's right to adhere to Federal and State laws as it pertains to disability. Particularly, it is the express intent that this Agreement shall not be interpreted in such a manner as to cause or constitute a violation of any law, specifically including Title VII of PL-88- 352, as amended, known as the Equal Employment Opportunity Act of 1964. All references to employees in this Agreement designate both sexes.
