No Third Party Beneficiary Status. The terms and provisions of this Agreement are intended solely for the benefit of each party hereto and their respective successors or permitted assigns, and it is not the intention of the parties to confer third-party beneficiary rights upon any other party, including employees.
No Third Party Beneficiary Status. Nothing in this Agreement, express or implied, shall be construed as conferring any third-party beneficiary status on any person or entity.

The members of the Rxxxx Group and divested Affiliates to the extent permitted by Section 3.06(b) shall be third-party beneficiaries under this Agreement but shall communicate and operate with Fidelity, and bring all actions, claims and other disputes with respect to Fidelity and this Agreement and the Services, through Rxxxx acting in its individual capacity and/or as agent for the aggrieved member or members of the Rxxxx Group and/or the divested Affiliates. Moreover, Rxxxx shall ensure that each divested Affiliate that continues to receive the Service executes the written agreement set forth in Section 3.06(b)(ii) and that Fidelity is a third party beneficiary under that Agreement.
