Third Party Beneficiary Status. Each Indemnified Party that is not a Party is hereby made a third-party beneficiary of the rights under this Article 7 (subject to the procedures, conditions, and obligations of this Article 7) as if such Indemnified Party were an original signatory hereto for such purposes.
Third Party Beneficiary Status. 12.17.1. HHMI is not a party to this Agreement and has no liability to any licensee, sublicensee, or user of anything covered by this Agreement, but HHMI is an intended third-party beneficiary of this Agreement and certain of its provisions are for the benefit of HHMI and are enforceable by HHMI in its own name.
12.17.2. Each Sublicensee is an intended third-party beneficiary of Section 4.2.2.3 with the right to enforce the same.
Third Party Beneficiary Status. Except with regard to the Vendor, as set forth herein, the Parties hereto do not intend this Agreement to confer any benefits or rights on any third party not a signatory hereto.
Third Party Beneficiary Status. To the extent necessary to accord MicroStar the full scope of entitlements, rights and authorities in relation to Brewing Company's agreements and arrangements with wholesalers as contemplated hereby, MicroStar shall be recognized as a third-party beneficiary of such agreements and arrangements. Brewing Company is an intended third-party beneficiary or all provisions of this Agreement concerning limitations on the use of the kegs by others and limitations on the use of Brewing Company's trademarks, labels, and logos.
Third Party Beneficiary Status. Tenant acknowledges that, by entering into this Lease with Landlord, Tenant has not become a third party beneficiary of any lease between Landlord and any other tenant of the Property, and that no part of the inducement to Tenant to enter into this Lease was any promise or covenant of Landlord, express or implied, to enforce any other lease for the benefit of Tenant.
Third Party Beneficiary Status. These Terms and any Orders or agreements incorporating such Terms including prices contained therein are intended for the benefit of both Buyer and BHTCL. In addition, Buyer is an intended third party beneficiary of any Terms, Orders, or agreements including prices contained therein between Seller and BHTCL. As intended third party beneficiaries, either Buyer or BHTCL may, at their sole discretion, purchase Goods from Seller at the most advantageous prices contained in either Buyer or BHTCL orders or agreements with Seller.
Third Party Beneficiary Status. This Agreement is intended solely for the benefit of the parties hereto, and it is not intended to benefit any other person or entity. No provision of this Agreement shall be used by any other person or entity, including patients, representatives of patients, technicians or employers or prospective employers of a technician, to impose any obligation, duty, or standard of care or practice upon either of the parties different from, or in addition to, whatever obligations, duties or standards may exist separate and apart from this Agreement.
Third Party Beneficiary Status. Notwithstanding any other provision of this Agreement to the contrary, it is agreed that upon purchase or their respective condominium unit, the purchaser and owner of each unit shall be deemed an intended third-party beneficiary of this Agreement, subject to all terms and conditions of this Agreement as is the Owner. This paragraph specifically modifies Section 1.3.7.5 of the B141 (1997 edition) and Section 9.7 of the B151 (1997 edition) of the AIA Agreement between Owner and Architect.
Third Party Beneficiary Status. Effective as of the Completion, Vendor agrees that it shall no longer be a third party beneficiary to (a) the agreements and contracts listed on Schedule 7.11 or (b) any other agreement or contract to which the Company, any Group Company, Purchaser and/or any Purchaser Affiliate is a party if, in the case of this Sub-Clause 7.11(b), were the Vendor to remain a third party beneficiary, this would be contrary to intention of the transactions contemplated by this Agreement, other than with respect to any indemnification and/or contribution provisions contained therein.
Third Party Beneficiary Status. This MOU is not intended to, and does not create any right, benefit, or trust responsibility, substantive or procedural, enforceable at law or equity, by any party against the United States, its agencies, its officers, or any person.
