NO WAIVER BY COUNTY. In the event the COUNTY does not insist upon strict performance by A-E or does not exercise any right or option herein conferred, such event shall not be deemed or construed as a waiver or a relinquishment to any extent of any right of COUNTY to insist on strict performance or to assert or rely upon any such terms or options on any future occasion.
NO WAIVER BY COUNTY. The failure of the County in any one or more instances to insist upon strict performance of any of the terms of this Contract or to exercise any option herein conferred, shall not be construed as a waiver or relinquishment to any extent of the right to assert or rely upon any such terms or option on any future occasion.
NO WAIVER BY COUNTY. No failure on the part of County to exercise any right or remedy under the Contract Documents shall operate as a waiver of any other right or remedy that County may have. A waiver by County of any breach or failure to perform under the Contract Documents shall not constitute a waiver of any subsequent breach or failure. The failure of County to enforce a requirement of the Contract Documents in one or more instances shall not preclude County from subsequently enforcing such requirement(s).
NO WAIVER BY COUNTY. Subject to Paragraph 9. (Disputes) of these General Conditions, inspections or approvals, or statements by any officer, agent or employee of County indicating Contractor's performance or any part thereof complies with the requirements of this Contract, or acceptance of the whole or any part of said performance, or payments therefor, or any combination of these acts, do not relieve Contractor's obligation to fulfill this Contract as prescribed; nor is the County thereby prevented from bringing any action for damages or enforcement arising from any failure to comply with any of the terms and conditions of this Contract.

In the event the COUNTY does not insist upon strict performance by PROJECT MANAGER or does not exercise any right or option herein conferred, such event shall not be deemed or construed as a waiver or a relinquishment to any extent of any right of COUNTY to insist on strict performance or to assert or rely upon any such terms or options on any future occasion.
NO WAIVER BY COUNTY. Nothing in this Article, and no actions taken pursuant to this Article shall constitute a waiver or surrender of any rights, remedies, claims or causes of action the County may have against Contractor or its Surety under any other provision of this Contract or any provision of law.

Except as expressly set forth in this Agreement, inspections, approvals, or statements by any officer, agent or employee of County indicating that Contractor’s performance or any part thereof complies with the requirements of this Agreement, or acceptance of the whole or any part of such performance, or payments therefor, or any combination of these acts, do not relieve Contractor’s obligation to fulfill this Agreement as prescribed; nor is the County thereby prevented from bringing any action for damages or enforcement arising from any failure to comply with any of the terms and conditions of this Agreement.
NO WAIVER BY COUNTY. Failure by County to pursue its legal and equitable remedies upon Xxxxxxxx's default shall not constitute a waiver of County's right to declare a default and exercise all of its rights under this Note and the Proximity Housing Deed of Trust. Failure to declare amounts due shall not constitute a waiver on the part of County of the right to declare them due in the event of any subsequent Transfer. Nor shall acceptance by County of any payment provided for herein constitute a waiver of County's right to require prompt payment of any remaining principal owed. A waiver of any term of the Note must be made in writing and shall be limited to the express written terms of such waiver.
NO WAIVER BY COUNTY. Failure by the County at any time to enforce its right to immediate payment in full for a default as set forth herein does not constitute a waiver by the County of its right to do so in the event of a continued or later default.
