NO XXXXXX ON DISCRETION. Nothing in this Agreement shall xxxxxx or prejudice the Council or the County Council’s statutory rights, powers, discretions and responsibilities under all statutes by-laws statutory instruments orders and regulations in the exercise of their functions as a local authority.
NO XXXXXX ON DISCRETION. 8.1 Save as provided for in clause 4 nothing herein contained or implied shall prejudice or affect the discretionary powers, duties and obligations of Suffolk County Council, East Suffolk Council or West Suffolk Council under all statutes, by-laws, instruments, orders and regulations in the exercise of its statutory functions.
NO XXXXXX ON DISCRETION. Without fettering the discretion of the Contract Administrator in carrying out its duties under the relevant Building Contract the Landlord shall procure that the Contract Administrator takes proper account of any reasonable representations made in accordance with clause 6.1.2 when considering whether or not to issue a Certificate of Practical Completion.
NO XXXXXX ON DISCRETION. 10.1. Nothing in this Agreement shall be taken to be or shall operate so as to xxxxxx or prejudice CWCC and CEC’s statutory rights, powers, discretions and responsibilities (save where legally permitted).

NO XXXXXX ON DISCRETION. The Authority shall consider on its merits in accordance with its statutory duties any request for action contained in a notice given in accordance with Clause 28B.2.1. Without in any way limiting the discretion of the Authority in responding to any such request, the Authority shall, in reaching any such decision, give consideration, inter alia, to the matters set out in Clause 28B.5. The decision of the Authority on the merits of the request shall not be subject to review under the Disputes Resolution Procedure.
NO XXXXXX ON DISCRETION. 15.1 Nothing in this Deed shall be taken to operate so as to xxxxxx or prejudice the statutory rights, powers, discretions or duties of the County Council or xxx Xxxxxxxxxx.
