NON-CANCELABLE LEASE. THIS LEASE IS A NET LEASE AND LESSEE'S OBLIGATION TO PAY RENT AND PERFORM ITS OBLIGATIONS HEREUNDER ARE ABSOLUTE, IRREVOCABLE AND UNCONDITIONAL UNDER ANY AND ALL CIRCUMSTANCES WHATSOEVER AND SHALL NOT BE SUBJECT TO ANY RIGHT OF SET OFF, COUNTERCLAIM, DEDUCTION, DEFENSE OR OTHER RIGHT WHICH LESSEE MAY HAVE AGAINST THE SUPPLIER, LESSOR OR ANY OTHER PARTY. LESSEE SHALL HAVE NO RIGHT TO TERMINATE (EXCEPT AS EXPRESSLY PROVIDED HEREIN) OR CANCEL THIS LEASE OR TO BE RELEASED OR DISCHARGED FROM ITS OBLIGATION HEREUNDER FOR ANY REASON WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DEFECTS IN, DESTRUCTION OF, DAMAGE TO OR INTERFERENCE WITH ANY USE OF THE EQUIPMENT (FOR ANY REASON WHATSOEVER, INCLUDING, WITHOUT LIMITATION, WAR, ACT OF GOD, STRIKE OR GOVERNMENTAL REGULATION), THE INVALIDITY, ILLEGALITY OR UNENFORCEABILITY (OR ANY ALLEGATION THEREOF) OF THIS LEASE OR ANY PROVISION HEREOF, OR ANY OTHER OCCURRENCE WHATSOEVER, WHETHER SIMILAR OR DISSIMILAR TO THE FOREGOING, WHETHER FORESEEN OR UNFORESEEN.
NON-CANCELABLE LEASE. This Lease cannot be cancelled or terminated except as expressly provided herein.
NON-CANCELABLE LEASE. I CANNOT CANCEL THIS DURING THE TERM HEREOF. I acknowledge that you will not be bound by any verbal agreements or amendments modifying the terms of this lease.
NON-CANCELABLE LEASE. THIS MASTER LEASE IS NON-CANCELABLE. When Lessee signs and delivers a Certificate of Acceptance for the Equipment, its obligations to pay all rent and other amounts for the Initial Lease Term and to perform as required under this Master Lease are unconditional, irrevocable and independent. These obligations are not subject to cancellation, termination, modification, repudiation, excuse or substitution by Lessee. Lessee is not entitled to any abatement, reduction, offset, defense or counterclaim with respect to these obligations for any reason whatsoever, whether arising out of default or other claims against Lessor, the Seller or the manufacturer of the Equipment, defects in or damage to the Equipment, its loss or destruction.
NON-CANCELABLE LEASE. NEITHER THE LEASE NOR ANY SCHEDULE CAN BE CANCELED BY XXXXXX DURING THE TERM HEREOF OR THEREOF.
NON-CANCELABLE LEASE. This lease and any Equipment Schedule hereto cannot be canceled or terminated except as expressly provided herein. Lessee agrees that its obligation to pay all rent and other sums payable hereunder and the rights of Lessor in and to such rent are absolute and unconditional and are not subject to any abatement, reduction, setoff, defense, counterclaim or recoupment due or alleged to be due to, or by reason of, any past, present or future claims which Lessee may have against Lessor, any assignee, any Manufacturer or Vendor, or against any person for any reason whatsoever.
NON-CANCELABLE LEASE. This Lease cannot be canceled by the Lessee during the term of this lease.
NON-CANCELABLE LEASE. This Lease cannot be canceled or terminated except as expressly provided herein. Notwithstanding the foregoing, Lessee may terminate this Lease with respect to all the FF&E (but not less than all) located at any one or more Centers, or all FF&E, by delivering written notice to Lessor of such termination (“Termination Notice”), from time to time. Upon Lessor’s receipt of any Termination Notice, if this Lease is not terminated with respect to all FF&E, Lessor and Lessee shall execute an Amendment to Equipment Lease Agreement specifying the FF&E remaining under the Lease and the Adjusted Rental Payment thereunder. Lessee’s Termination Notice(s) will be effective ninety (90) days after delivery to Lessor whether or the above described amendment has been executed.
NON-CANCELABLE LEASE. LESSEE shall pay the total rents for the entire term to LESSOR, or LESSOR'S assignee (as defined herein), and such payment of rents shall be absolute and unconditional without right to setoff, reduction, abatement, counterclaim, recoupment, or defense of any kind whatsoever.
NON-CANCELABLE LEASE. This Lease cannot be canceled, prepaid or terminated except as expressly provided herein or in the applicable Schedule.
