Non-Discrimination and Equal Employment Opportunity. During A. Throughout the performance term of this contractFranchise, the Vendor agrees as follows: Grantee shall fully comply with the equal employment opportunity requirements of federal, state, and local law and, in particular, FCC rules and regulations relating thereto. Upon request by the City, the Grantee shall furnish the City a copy of any statistical report which the Grantee may be required to file with the FCC, along with proof of the Grantee's annual certification of compliance. In the event the Grantee is at any time determined by the FCC not to be in compliance with said FCC rules or regulations, the Grantee shall notify the City within 15 days of its notice of such noncompliance from the FCC.
B. Subject to FCC rules and regulations, the Grantee shall not unlawfully, in its rates or charges, or in the availability of the services or facilities of its cable system, or in any other respect, make or grant undue preferences or advantages to any subscriber, potential subscriber, or group of subscribers or potential subscribers, nor shall the Grantee subject any such persons or group of persons to any undue prejudice or any disadvantage. However, the Grantee may offer temporary, promotional discounts or package offers in order to attract or maintain subscribers, provided that such discounts or packages are offered on a non-discriminatory basis to similar classes or types of subscribers throughout the City. The Vendor will Grantee shall not unlawfully deny, delay, or otherwise burden service or discriminate against any employee or applicant for employment because subscribers within its franchise area on the basis of age, race, religion, creed, age, color, sex, marital status, sexual orientation, gender identity, political ideology, ancestry, national origin, or the presence of any sensory, mental or physical handicap, unless based upon a bona fide occupational qualification. The Vendor will take affirmative action to ensure that applicants are employed, and that employees are treated during employment, without regard to their creed, religion, race, age, color, sex, national origin, marital status, sexual preference, physical or mental disability, or political ideologyaffiliation.
