Common use of Non-Duplication with Medicare Clause in Contracts

Non-Duplication with Medicare. If the retiree or retiree’s dependent is entitled or would be entitled if enrolled, to have any part of the cost of eligible services or supplies paid by Medicare Parts A or B, even though the retiree does not enroll in Medicare or waives or fails to claim Medical Benefits the Service Plan will reduce the amount furnished under this Contract so that the total amount paid under this Contract and Medicare or what is estimated to be paid under Medicare does not exceed the benefits provided by the plan.
