NON-INTERRUPTION OF OPERATIONS Clause Samples

The Non-Interruption of Operations clause is designed to ensure that the normal business activities or services of a party are not disrupted during the course of a contract or project. In practice, this clause may require parties to schedule maintenance, repairs, or other potentially disruptive activities outside of regular business hours, or to implement measures that minimize any impact on ongoing operations. Its core function is to protect business continuity and prevent losses or inefficiencies that could arise from unnecessary interruptions.
NON-INTERRUPTION OF OPERATIONS. During the life of this Agreement and the procedures set forth in Article II of this Agreement, the Association shall not authorize or engage in any interruption of the functions and operations of the College, including but not limited to strikes, slowdowns, stoppages of work, or any other similar refusal to perform and carry out the duties and responsibilities of Employees in any manner or degree, with the exception of a re-opener on salary, wages and fringe benefits. In the event an agreement is not reached under a reopener, the Association shall have the right to withhold its services as set forth in ORC 4117.
