Non-Promotion on Layoff. Except in cases where an employee has previously been 1 laid-off from a higher paid classification and is eligible for recall in that classification, no employee 2 shall be recalled to employment in a classification with a higher pay range than the pay range of the 3 classification held at the time of layoff. In the event the classification from which the employee was 4 laid off moves to a higher pay range, the employee will continue to have recall rights to that 5 classification or to any new classification which includes the classification held at the time of layoff.
