Non-Release. Except as otherwise specifically provided in this Agreement, nothing in this Agreement shall limit, prejudice or otherwise interfere with the rights of any Settling State or any Participating Manufacturer to pursue any and all rights and remedies it may have against any Non-Participating Manufacturer or other non-Released Party.
Non-Release. The security constituted hereby shall not be released, discharged or in any way affected by:
Non-Release. This Guaranty shall remain in full force and effect ----------- without regard to, and shall not be released, discharged or in any way impaired by: (a) any amendment or modification of, or supplement to, or extension or renewal (pursuant to an option granted, holding over, or otherwise) of the Lease (whether material or otherwise) or any assignment or transfer thereof, all of which Guarantor hereby consents to; (b) any exercise or non-exercise of any right, power, remedy or privilege under or in respect of the Lease or this Guaranty or any waiver, consent or approval by Landlord with respect to any of the covenants, terms, conditions or agreements contained in the Lease or any indulgences, forbearance or extensions of time for performance or observance allowed to Tenant from time to time and for any length of time; (c) the voluntary or involuntary liquidation or dissolution of Tenant, the sale of substantially all of the assets of Tenant, the marshaling of assets on liabilities, receiverships, conservatorship, insolvency, bankruptcy, assignment for the benefit of creditors, reorganizations, arrangement, composition or readjustment of, or other similar proceeding affecting Tenant or any of Tenant's assets; (d) any limitation on the liability or obligation of Tenant under the Lease or its estate in bankruptcy or of any remedy for the enforcement thereof, resulting from the operation of any present or future provision of the National Bankruptcy Act or other statute or from the decision of any court; or (e) any extension, forbearance or leniency extended by Landlord to Tenant.
Non-Release. The conveyance or assignment of the Oil & Gas Interests to another party does not release Purchaser from the obligations under this Section 7.
Non-Release. Notwithstanding anything in this Agreement to the contrary, nothing in this Agreement shall constitute a release, settlement, acquittal and/or discharge of any claims or causes of action of any Party or any Withdrawing Nominee against any Other Party or any Withdrawing Nominee or any agent, representative, advisor, consultant or attorney of any Other Party or any Withdrawing Nominee.
Non-Release. Upon termination of this Agreement pursuant to this Section 9, no Party shall be relieved of any obligations incurred prior to such termination unless otherwise mutually agreed to in writing by Gelesis and One Italy. In the event the Parties disagree as to whether a default has occurred or that a default has been cured, the Parties shall submit the dispute to arbitration pursuant to Section 14, and this Agreement shall remain in effect until such arbitration is concluded.
Non-Release. Except as provided in Section 6.01, ------------ ----------- no assignment or transfer or mortgage or subletting by Tenant shall relieve Tenant of the obligations of Tenant under this Lease.
Non-Release the Platform stating or indicating in any way that it will not broadcast or make available the Programme such that in the opinion of Te Māngai Pāho the Programme is unlikely to be broadcast or released within the Licence Period; and
Non-Release. No permitted transfer, assignment, delegation or subletting by Licensee shall release or relieve Licensee of any of its obligations under this Agreement incurred prior to such transfer, assignment, delegation or subletting, and Licensee shall remain fully obligated and liable to Tampa Electric for such obligations incurred under this Agreement prior to such transfer, assignment, delegation or subletting, notwithstanding any such permitted transfer, assignment, delegation or subletting.
Non-Release. Nothing in this Agreement shall limit, prejudice or otherwise interfere with the rights (1) of any PM to pursue any and all rights and remedies it may have against any other Settling State or (2) of New York to pursue any and all rights and remedies it may have against any Participating Manufacturer that is not a PM.
