Non-warrantable Items. This statement of conditions that are not subject to this Express Limited Home Warranty explains some of the changes and need for maintenance that may occur in a new Home over the first year or so of occupancy. A Home requires more maintenance and care than most products because it is made of many different components, each with its own special characteristics. Like many products made by humans, a house is not perfect. It may show some minor flaws and unforesee- able defects, and it may require some adjustments and touching up. Redstone Homes will correct certain defects that arise during defined time periods after construction is completed and the Purchaser has made a final walk through during the Homeowner Orientation Meeting before the closing. Some items that are not covered by this Express Limited Home Warranty may be covered by Manufacturers’ Warranties. Some conditions, including, but not limited to, those listed in this statement of non-warrantable items, are not covered under this Express Limited Home Warranty. The Purchaser should read these carefully and understand that the Purchaser has not contracted for Redstone Homes to correct certain types of problems that may occur in the Home. These guidelines will alert the Purchaser to certain types of maintenance that are the responsibility of the Purchaser and that could lead to problems if neglected. The following list outlines some of the conditions that are not warranted by Redstone Homes. The Purchaser should be sure to understand this list. If the Purchaser has any questions, the Purchaser should ask Redstone Homes and feel free to consult an attorney before signing the acknowledgment.

  • Merchantable Inventory All Inventory is in all material respects of good and marketable quality, free from all material defects, except for Inventory for which adequate reserves have been made.

  • Basic Equipment Warranty The Contractor warrants that all equipment rented or supplied under this Agreement shall be in good working order and shall conform to the needs specified by the Judicial Council. The Contractor shall immediately replace any inoperative equipment with operative equipment, or make all adjustments, repairs, and parts replacements required to maintain the equipment rented or supplied hereunder in working condition.

  • WARRANTY OF TITLE TO GAS 1. Seller warrants the title to all gas delivered hereunder and the right to sell the same and that such gas shall be free and clear from all liens and adverse claims.

  • Manufacturer’s Warranties If a Lease Vehicle is covered by a Manufacturer’s warranty, the Lessee, during the Vehicle Term for such Lease Vehicle, shall have the right to make any claims under such warranty that the Lessor could make.

  • Construction Warranty At the Closing, Seller shall assign to Buyer all construction warranties with respect to the Hotel, which assignment shall be in form and substance reasonably satisfactory to Buyer, including a warranty by the Contractor, for the period ending not sooner than one (1) year after the date the Hotel is Substantially Completed, in the form of the warranty attached hereto as Exhibit H (the “Construction Warranty”).
