NOT A LEASE. It is expressly understood and agreed by both Department and Concessionaire that no building, land or equipment included within the description of the Concession Premises or any other property comprising part of the Area is hereby leased to Concessionaire. Department's control, management and direction over the Concession Premises or any other property comprising part of the Area are not hereby assigned in any way to Concessionaire.

Notwithstanding any provisions of this Agreement to the contrary, Company and Contractor acknowledge and agree that (i) Contractor’s provision of equipment, material, supplies and labor under this Agreement is solely in furtherance of Contractor’s performance of the Services for Company; (ii) Contractor shall be permitted to exchange or substitute pieces of equipment used in the performance of Services; and, (iii) no equipment provided by Contractor during the performance of the Services under this Agreement is a right-of-use asset.
NOT A LEASE. This Co-location Addendum is a services agreement and is ----------- not intended to and will not constitute a lease of real property. Customer acknowledges and agrees that it has no rights as a tenant or otherwise under any real property and/or landlord/tenant laws, regulations or ordinances. Upon termination of this Addendum for any reason, Exodus will have the right to remove immediately all of Customer's Equipment located at the Facility.
