Notice and Report Pay. Nurses who are scheduled to report for work and 9 who are permitted to come to work without receiving prior notice that no work is 10 available in their regular assignments shall perform any nursing work to which they may 11 be assigned. 12 1. When the Medical Center is unable to utilize such nurse and the 13 reason for lack of work is within the control of the Medical Center, the nurse shall 14 be paid an amount equivalent to four (4) hours times the straight-time hourly rate 15 plus applicable shift differential; provided, however, that a nurse who was 16 scheduled to work less than four (4) hours on such day shall be paid for his/her 17 regularly scheduled number of hours of work for reporting and not working 18 through no fault of his/her own. 19 2. The provisions of this section shall not apply if the lack of work is 20 not within the control of the Medical Center or if the Medical Center makes a 21 reasonable effort to notify the nurse by telephone not to report for work at least 22 two (2) hours before his/her scheduled time to work. 23 3. It shall be the responsibility of the nurse to notify the Medical 24 Center of his/her current address and telephone number. Failure to do so shall 25 preclude the Medical Center from the notification requirements and the payment 26 of the above minimum guarantee. 27 4. If a nurse is dismissed and is not notified before the start of the next 28 shift that he/she would have otherwise worked, he/she shall receive four (4) 29 hours’ pay in accordance with the provisions of this section.

If In the event of a lack of work as determined by leadership, the Registered 21 nurse is dismissed and is not notified before may request to waive the start of the next 28 shift that he/she would have otherwise worked, he/she shall receive four (4) 29 hours’ pay in accordance with -hour requirement and, if 22 approved, may use PTO or unpaid time for the provisions of this sectionfour (4)-hour time period.
