Notice and Variation Requirements. An employee shall give no less than eight weeks written notice to the Employer of: i) the date the employee proposes to commence paid or unpaid adoption leave and ii) the period of leave to be taken. An employee is not in breach of subclause 6.16.5(a) by failing to give the required period of notice if such failure is due to the requirement of the adoption agency to accept earlier or later placement of a child, or other compelling circumstances. An employee proceeding on adoption leave may elect to take a shorter period of adoption leave to that provided by this subclause and may at any time during that period elect to reduce or seek to extend the period stated in the original application, provided four weeks written notice is provided.
