Notice by Publication. In addition to notices required to be given in any other manner hereunder, all notices required to be given to the Noteholders will be effected by publication at least once, if any Notes are listed on a stock exchange and the rules of such stock exchange so require, in a publication meeting the requirements of such stock exchange.
Notice by Publication. The Interior Defendants shall give notice to all owners that the Secretary was unable to provide notice pursuant to subparagraphs (a) thru (c) above, by publication of the opportunity to convey fractionated interests as follows:
(1) at least two (2) times in a newspaper of general circulation in the county or counties where the subject parcel of land is located or, if there is an Indian tribe with jurisdiction over the parcel of land and that tribe publishes a tribal newspaper or newsletter at least once every month, one (1) time in such newspaper of general circulation and one (1) time in such tribal newspaper or newsletter for a period of six (6) months;
(2) posting such notice in a conspicuous place in the tribal headquarters or administration building (or such other tribal building determined by the Interior Defendants to be most appropriate for giving public notice) of the Indian tribe with jurisdiction over the parcel of land, if any; and
(3) in addition to the foregoing, in the Interior Defendants' discretion, publishing notice in any other place or means that the Interior Defendants determine to be appropriate.
Notice by Publication. The Settlement Administrator shall arrange for the publication of the Publication Notice in the online and offline versions of three widely-circulated newspapers in the state of Illinois to be displayed for at least three non-consecutive days (not in the same week), beginning no later than fourteen (14) Days after the Preliminary Approval Order is entered. Such publication notice shall use the same font and imagery as Defendant’s website.
Notice by Publication. 63.1 Notice by Publication shall be given by:
(a) publishing the notice:
(i) In the United Kingdom in The Financial Times, Insurance Day and Lloyd’s List;
(ii) In Australia in The Australian and The Australian Financial Review; and
(iii) In the United States, in USA Today; and in respect of each Notice by Publication a substitute publication will be chosen by the Scheme Administrators in the event that one of the nominated publications ceases to exist, is published in combination with another publication or is known by another name.
(b) by causing the notice to be posted on the HIH Website, which notice shall remain posted until the event about which notice is given.
Notice by Publication. 71 ARTICLE VIII ALLOCATION AND APPLICATION OF COLLECTIONS
Notice by Publication. Subject to approval by the Court, the Class Notice shall be published as follows: a web-based banner ad program on at least two websites that, according to Lead Plaintiffs’ Counsel and Receiver, are the amongst the high ranking websites for cryptocurrency investors. Further, the Class Notice will be posted on the Settlement Website, Plaintiffs’ Lead Counsel’s Websites, and at the Cryptsy Receivership Website.
Notice by Publication. The County Coordinator shall publish a notice of the public hearing authorized by Section 7 hereof at least 20 days prior to such public hearing. The notice shall be published no later than August 25, 2022, in substantially the form attached hereto as Appendix B.
Notice by Publication. 16.5.1 Notice required to be published in accordance with this Clause 16.6 shall be given by notice published:
i. in the Cayman Islands, in the Cayman Compass and Cayman Gazette;
ii. in the United Kingdom, in the Financial Times;
iii. in the United States, in the USA Today; and
iv. in addition to each of the published notices cited at paragraphs (i) to (iii), by causing the notice to be posted on the Scheme Website, which notice shall remain posted until the event about which notice is being given takes place.
16.5.2 A substitute publication will be chosen by the Scheme Supervisors in the event that one of the nominated publications cited in Clause 16.6.1 ceases to exist, is published in combination with another publication or is known by another name.
Notice by Publication. Because class certification is sought solely pursuant to Fed. R. Civ. P. 23(b)(2), notice to class members of the certification is not required and class members may not opt out. See Fed. R. Civ. P. 23(b)(2); Xxxxxxx on Class Actions, § 8.13. The parties therefore agree that notice need not be given of the certification of the class. Rule 23(e) provides that notice of the proposed dismissal or compromise of a class action shall be given to all class members in such manner as the court directs. The parties agree to cooperate in the drafting of a notice (“Notice”) that satisfies the requirements of Rule 23(e). The parties further agree that notice as required by Rule 23(e) can be achieved in this case by Cardtronics (1) making the Notice and this Agreement available on its website; (2) mailing a copy of the Notice to the list of organizations attached hereto as Exhibit A; and (3) publishing the Notice as a one-half page advertisement in the Braille Monitor and the Braille Forum and as one-eighth page advertisements in the classified ad sections of The New York Times, Los Angeles Times, and USA Today. Cardtronics shall undertake appropriate notice as described herein and shall bear the cost of doing so.
Notice by Publication. Notice by Publication pursuant to the Schemes may be given by:
(a) publishing the notice in any of the following newspapers:
(i) The West Australian; and
(ii) either:
(A) The Australian; or
(B) The Australian Financial Review, or, in the event that one of the nominated publications ceases to exist, is published in combination with another publication, or is known by another name, a substitute publication chosen by the Schemes Administrator; and
(b) by causing the notice to be posted on the Website, which notice shall remain posted until immediately after the event about which notice is given.
