Notice & Communication i. Any notice, direction, instruction or any other communication related to the Policy should be made in writing.

Any Notice to be given by CFIL to the borrower, shall be effective and deemed to have been duly and sufficiently served on the Borrower, three days after the same shall have been delivered to the post office/couriers properly addressed to the Borrower at the address given at the end of this agreement and if delivered to the Borrower against acknowledgement, it shall be deemed to have been duly served as on the date of delivery.

Notice & Communication. (a) Each notice, demand or other communication given or made under this Agreement shall be in writing and delivered or sent to the relevant Party at its address or fax number set out below (or such other address or fax number as the addressee has by seven (7) Business Days' prior written notice specified to the other Parties). Any notice, demand or other communication given or made by letter between countries shall be delivered by registered airmail or international courier service. Any notice, demand or other communication so addressed to the relevant Party shall be deemed to have been delivered (i) if delivered in person or by messenger, when proof of delivery is obtained by the delivering Party, (ii) if sent by post within the same country, on the fifth day following posting, and if sent by post to another country, on the tenth day following posting, and (iii) if given or made by fax, upon dispatch and the receipt of a transmission report confirming dispatch.

(a) Unless otherwise stated, all notices, approvals, instructions and other communications for the purposes of this Agreement may be given by facsimile, by personal delivery or by sending the same by prepaid registered mail addressed to the Party concerned at its address stated in the title of this Agreement or the fax numbers set out below and/or any other address subsequently notified to the other Party for the purposes of this section 18.4 and shall be deemed to be effective (i) in the case of registered mail, 3 (three) Banking Days after posting, (ii) in the case of facsimile at the time when dispatched with a report confirming proper transmission or (iii) in the case of personal delivery, at the time of delivery.

The term “electronic communication” means any communication of instructions by telephone, facsimile, email, world wide web initiated internet message, wire or other method of telecommunication or electronic transmission. DirectCash will consider any electronic communication apparently received from you or in your name to be duly authorized by you. You authorize DirectCash to rely and act on any such communi- cation. If the communication is by facsimile transmission, DirectCash will be entitled to act upon any signature purporting to be your signature. DirectCash may, at your request, forward to you copies of any statements, instruments or other documents by facsimile or other electronic transmission to the number or address provided by you from time to time. For mutual protection, DirectCash may record all telephone calls that relate to or include instructions relating to this Agreement. You agree that XxxxxxXxxx's records regarding any electronic communication will be admissible in any legal, administrative or other proceedings as if such records were original written documents. DirectCash's records will be conclusive proof of the information contained in such electronic com- munications.

If DirectCash tries to verify Customer's signature on a facsimile transmission or the validity of any instructions electronically communicated (though DirectCash is not obligated to do so) and is unable to do so to DirectCash's satisfaction, DirectCash may delay in acting on or refuse to act on such instructions. DirectCash may, at the Customer's request, forward to the Customer copies of any statements, instruments or other documents by facsimile or other electronic transmission to the number or address provided by you from time to time. For mutual protection, DirectCash may record all telephone calls that relate to the use of or include instructions relating to the use of the Cash Card. The Customer agrees that DirectCash's records regarding any electronic communication will be admissible in any legal, administrative or other proceedings as if such records were original written documents. DirectCash's records will be conclusive proof of the information contained in such electronic communications.

Any notice or other communication to be given under this Agreement will be in writing and signed by or on behalf of the party serving the said notice and may be served by sending via facsimile, delivering by hand or sending by first class post to the address provided within this Agreement and marked for the attention of the relevant party.

Any notice, request, instruction or other document to be given hereunder to any party by another shall be in writing and delivered personally or sent by certified or registered mail, postage prepaid, to the addresses set forth in this Agreement. A party may change the address to which notices are to be sent to it by giving written notice of such change of address to the other parties in the manner herein provided for giving notice. Nothing contained in this Agreement is intended to, or shall be construed in any manner, as creating or establishing the relationship of employer/employee between the parties. The Developer shall at all times remain a “Vendor” with respect to the Project activities to be performed under this Agreement. The City shall be exempt from payment of all Unemployment Compensation, FICA, retirement, life and/or medical insurance and Workers’ Compensation Insurance.
