Notice of Data Breach. The Requestor shall immediately notify the Chief Information Security Office for the Massachusetts Department of Transportation at XxxxXxxXxxx@xxx.xxxxx.xx.xx in the event of a data breach or misuse of RMV data. The Requestor is responsible for all notifications and remediation pursuant to M.G.L. Chapter 93H.
Notice of Data Breach. If Prodly becomes aware that Customer Data was accessed or disclosed in breach of this agreement, Prodly will so notify Customer without undue delay, immediately act to eliminate the breach and preserve forensic evidence, and provide available information to Customer regarding the nature and scope of the breach.

Infocyte will give highest priority to immediately correcting any data breach, and will devote such resources as may be required to accomplish that goal. To the extent that Customer, in its sole reasonable discretion, deems warranted, Customer may provide notice to any or all parties affected by any data breach. In such case, Infocyte will consult with Customer in a timely fashion regarding appropriate steps required to notify third parties. Infocyte will provide Customer with information about what Infocyte has done or plans to do to minimize any harmful effect of the unauthorized use or disclosure of, or access to, Confidential Information.

In the event of any suspected, alleged or confirmed loss, disclosure, theft or compromise of cardholder data or card transaction information relating the cardholder data services (a “Compromised Data Event”), Third Party Vendor shall immediately notify by fax The Ohio State University Office of the Treasurer, 614-292- 7568 and by overnight mail delivered to The Office of the Treasurer at The Ohio State University, 0000 Xxxxx Xxxx Xxxxxx, Xxxxx 000 Xxxxxxxx, Xxxx 00000, and in the manner required in the PCI DSS requirements, and provide the PCI Council, the card organizations, the acquiring financial institution, Merchant Processor, and their respective designees immediate access to conduct an examination of Third Party Vendor’s Merchant Equipment and Systems, if applicable, facilities and all pertinent procedures and records. Third Party Vendor shall fully cooperate with any examinations provided for in this paragraph. Upon Third Party Vendor’s suspected or actual discovery of a Compromised Data Event, Third Party Vendor will not alter or destroy any related records and will maintain complete and accurate documentation regarding any modifications made to the records. Third Party Vendor agrees to permit Merchant Processor to conduct remote scans of its Merchant Systems.

If HRC becomes aware of any breach of HRC’s security leading to the unauthorized access to or destruction, disclosure, acquisition or modification of Customer Data by a third party without the proper authorization and contrary to the terms of this Agreement (a “Data Breach”), HRC will notify the Customer of such Data Breach without undue delay and take all action as may be necessary to preserve forensic evidence and to eliminate the cause of such Data Breach. Subject to HRC’s confidentiality obligations to other customers of HRC, HRC will provide Customer with all information necessary for Customer to fully understand the nature and scope of the Data Breach. Customer may provide notice to any or all parties affected by the Data Breach after consulting with HRC at least 24 hours prior to disclosure of such Data Breach. In such case, HRC will cooperate with Customer in a timely fashion regarding appropriate steps required to notify third parties. HRC will provide Customer with information about what HRC has done or plans to do to minimize any harmful effect or the unauthorized use or disclosure of, or access to, the Customer Data.

If Liongard becomes aware that Partner Confidential Information has been accessed, disclosed, or acquired without proper authorization and contrary to the terms of this agreement, Liongard will alert Partner of any data breach without undue delay, immediately take such actions as may be necessary to preserve forensic evidence and eliminate the cause of the data breach, and provide available information to Partner regarding the nature and scope of the breach.

If SearchStax becomes aware that Customer Data was accessed or disclosed in breach of this agreement, SearchStax will so notify Customer without undue delay, immediately act to eliminate the breach and preserve forensic evidence, and provide available information to Customer regarding the nature and scope of the breach.

If WorkRails becomes aware that Customer Content was accessed or disclosed in breach of this agreement, WorkRails will so notify Customer without undue delay, immediately act to eliminate the breach and preserve forensic evidence, and provide available information to Customer regarding the nature and scope of the breach.

Third Party Vendor shall fully cooperate with any examinations provided for in the preceding paragraph. Upon Third Party Vendor’s suspected or actual discovery of a Compromised Data Event, Third Party Vendor will not alter or destroy any related records and will maintain complete and accurate documentation regarding any modifications made to the records.
