Notice to Attaching Party. If any of Attaching Party’s facilities for which no occupancy permit is presently in effect are found attached to SBC-13STATE’s poles or anchors or within any part of SBC-13STATE’s conduit system, SBC-13STATE, without prejudice to other rights or remedies available to SBC-13STATE under this Agreement, and without prejudice to any rights or remedies which may exist independent of this Agreement, shall send a written notice to Attaching Party advising Attaching Party that no occupancy permit is presently in effect with respect to the facilities and that Attaching Party must, within 30 days, respond to the notice as provided in Section 27.6 of this Agreement.

Notice to Attaching Party. 18.2.1 If any of Attaching Party’s Facilities for which no occupancy permit is presently in effect are found attached to AT&T-22STATE’s Poles or Anchors or within any part of AT&T-22STATE’s Conduit System, AT&T- 22STATE, without prejudice to other rights or remedies available to AT&T-22STATE under this Appendix, and without prejudice to any rights or remedies which may exist independent of this Appendix, shall send a written Notice to Attaching Party advising Attaching Party that no occupancy permit is presently in effect with respect to the Facilities. Within thirty (30) calendar days after receiving a Notice, Attaching Party shall acknowledge receipt of the Notice by submitting to AT&T-22STATE, in writing, an Application for a new or amended Occupancy permit with respect to such Facilities.

  • NOTICE OF DELAYS Except as otherwise provided under this Contract, when either party has knowledge that any actual or potential situation is delaying or threatens to delay the timely performance of this Contract, that party shall, within one (1) business day, give notice thereof, including all relevant information with respect thereto, to the other party.
