Number of Class Members. Defendant estimates that there are 113,839 18 Class Members. Defendant will confidentially identify to the Settlement Administrator the Class 19 Members on whom Defendant obtained a background report for employment purposes by using The 20 Challenged Disclosure Form.
Number of Class Members. Defendants represent that the number of Class members who worked during the period from February 24, 2020, through August 31, 2023 (the “Discovery Period”) is approximately 90 individuals. Defendants agree that this representation is material to Plaintiff’s decision to settle the Class claims on the terms set forth in this document. If more than five (5) additional Class Members are identified for the Discovery Period, Defendants agree to increase the total award payment proportionate to the number of additional shifts worked by any additional Class members identified for that period.
Number of Class Members. Defendant estimates that there are 48,935 8 Class Members.
Number of Class Members. Defendants represent that to the best of their knowledge, the number of Class Members who worked during the period from April 1, 2013, through March 15, 2019, is no more than 268. Defendants agree this representation is material to Plaintiffs’ decision to settle the Class claims on the terms set forth in this Agreement.
Number of Class Members. The number of Class Members is 15,028. If more than 15,028 Class Members participate in this Settlement , Defendant will pay a proportionate additional amount into the Fund for each additional Class Member to claim from, on the same basis as existing Class Members.
