Obligation to act in Good Faith. We each agree that we must deal with each other in good faith in relation to the supply of Milk. Without limitation, that duty of good faith applies in the circumstances specified in section 11(3) of the Dairy Code and, in determining whether either of us has acted in good faith, the matters identified in section 11(4) of the Dairy Code may be taken into account.
Obligation to act in Good Faith. The parties must at all times: (1) cooperate and use their best endeavours to profitably and professionally give effect to their rights and obligations set out in this document; (2) not unreasonably delay any action, approval, direction, determination or decision which is required of them; (3) make approvals or decisions that are required of them in good faith and in a manner consistent with the completion of the transactions set out in this document; and (4) be just and faithful in their activities and dealings with the other parties.
Obligation to act in Good Faith. FortisBC and the Municipality acknowledge and agree that they will act in good faith, in carrying out the terms and conditions of this Agreement and within reasonable time frames, carry out the obligations under this Agreement. FortisBC and the Municipality will at all times carry out all work and operations with the due care and attention that is necessary to safeguard the interests of the public, their own employees, and the other party’s employees.

Obligation to act in Good Faith. Parties to a dispute will comply with the following when utilising this Dispute Resolution Procedure: (a) disputes dealt with under this Disputes Resolution Procedure must be genuine disputes which are sought to be resolved in good faith; (b) disputes will not be raised or progressed for any purpose other than the effective resolution of the specific dispute; (c) all parties to a dispute will cooperate to ensure that disputes are resolved as quickly and efficiently as possible; (d) the requirements of sub clause 13.4 will not be invoked by any party to a dispute in a way which unreasonably or unnecessarily obstructs the organisation or operational affairs of the University or any part of it, and, where appropriate, parties to a dispute will negotiate in good faith to reach an agreement on how the requirements of sub clause 13.4 are to be applied to meet this objective.
