Observance of Tests. Owner shall have the right to observe all tests of the Work and the Project performed by Design-Builder pursuant to the Contract Documents.
Observance of Tests. ‌ Buyer through Xxxxx's Representative or authorized Representative and one (1) additional employee, agent, or expert shall have the right to observe all tests of the Project and tests of the Work including (to the extent Seller is able to arrange for such observation) at the {SOLARModules/WINDTurbine} Supplier's facilities, in each case with reasonable frequency, at reasonable times during normal business hours and upon reasonable advance notice except as otherwise provided in Section 2.4.12. Seller shall give at least five (5) Business Days' prior notice, unless another time period is otherwise specified in the Scope of Work, to Buyer of any Project tests including the time and location of the tests. Additional employees, agents, or experts of Buyer may be present during such activities upon reasonable notice, at reasonable times with reasonable frequency.
Observance of Tests. Each of the parties identified in Section 9.1 and Section 21.2.4 shall have the right to observe all tests of the Work and the Facility.

  • Observance of Law Tenant shall not use the Premises or permit anything to be done in or about the Premises which will in any way conflict with any law, statute, ordinance or governmental rule or regulation now in force or which may hereafter be enacted or promulgated. The judgment of any court of competent jurisdiction or the admission of Tenant in any action against Tenant, whether Landlord is a party thereto or not, that Tenant has violated any law, ordinance or governmental rule, regulation or requirement, shall be conclusive of that fact as between Landlord and Tenant.

  • Observance of Holidays The Board of Trustees may establish calendars that observe holidays on dates other than those listed above, or as modified by current institutional practices.

  • Observance (a) When a holiday specified in Section 1 of this Article falls on a Saturday, the preceding Friday shall be recognized as the holiday. When a holiday specified in Section 1 of this Article falls on a Sunday, the following Monday shall be recognized as the holiday. (b) When a holiday specified in Section 1 of this Article falls on a regularly scheduled day off, the employee shall have the choice of receiving an alternate eight (8) hours of compensatory straight time or straight-time pay. Part-time, seasonal, and job share employees will receive a prorated amount of compensatory time or straight-time pay based on the calculation in Section 3(b). (c) However, the Parties recognize that some positions must be staffed on holidays, and that employees in these positions cannot be released from duty on those holidays. Part (a) of this Section shall not apply to employees in these positions and the holiday shall be observed on the actual day specified in Section 1. Employees filling such positions will be notified in writing prior to hiring or when their work assignment is changed that they may have to work on certain holidays.

  • Performance of Covenants and Satisfaction of Conditions To use its reasonable best efforts to do and perform all things required to be done or performed under this Agreement by the Company prior to each Closing Date and to satisfy all conditions precedent to the delivery of the Firm Stock and the Optional Stock.

  • MAINTENANCE OF CONDITIONS Conditions of employment in effect at the execution of this Agreement shall, except as improved herein, be maintained during the term of this Agreement.

  • Performance of Covenants The Company shall have performed or complied with in all material respects all agreements and covenants required to be performed or complied with by it under this Agreement at or prior to the Effective Time.

  • CONTRACT COMPLIANCE REQUIREMENT The HUB requirement on this Contract is 0%. The student engagement requirement of this Contract is 0 hours. The Career Education requirement for this Contract is 0 hours. Failure to achieve these requirements may result in the application of some or all of the sanctions set forth in Administrative Policy 3.10, which is hereby incorporated by reference.
