This letter will include a summary of Employment Insurance Commission procedures to be followed by the employees, the effect on Company insurance plans and any other relevant information.
10.09.05 An employee whom the Company is unable to contact to advise of O.D.S. will be placed on O.D.S. and the written notice provided for in Article 10.09.04 will be sent to the employee's last known address. An employee who is out of the base and who, due to an inability to travel, the Company is unable to contact to advise of work assignment will not be disciplined. Such employee will be placed on O.D.S. but will be returned to work within twenty-four (24) hours notice of intended action before being placed the Company having knowledge of their return to the base, provided their seniority is sufficient to retain a work assignment.
10.09.06 The shift schedules of employees who are retained on "off-duty status without pay"may be altered to conform with major changes in the normal working hours or work requirements at a location. Where such notice is verbal it Notice of any change to shift starting and terminating times will be subsequently confirmed in writing. In any event, "off-duty status without pay" will not commence until provided to each affected employee at least twenty-four (24) hours after cessation in advance of servicethe starting time of their originally scheduled shift or their new shift, whichever is the earlier. Notice of any change to days on and days off will be provided to each affected employee at least forty-eight (48) hours in advance of their originally scheduled day on or their originally scheduled day off, whichever is the earlier.
.04 Where 10.09.07 Overtime will be offered in order of seniority, first to employees on O.D.S. who are retained or returned to duty qualified to perform required workthe work and who have indicated their availability, senior qualified and then to employees shall who have been retained on duty. The requirements of Article 10.09.04 will be assigned waived for the employees returning to O.D.S.
10.09.08 Training which has been arranged or is ongoing at the time the Company's operations are affected will proceed as scheduled and the possibility of providing other training will be discussed with the Union.
10.09.09 An employee who is on vacation will continue on vacation and, if applicable, will be placed on O.D.S. in accordance with Article 10.09.05 to take effect on the basis day they were to return to work. An employee retained on duty will commence vacation as scheduled. An employee placed on O.D.S. will either commence their vacation as scheduled or alternatively, may elect to receive their vacation pay at a later date.
10.09.10 An employee receiving disability insurance benefits will continue to receive those benefits until they are scheduled to return to work at which time they will be placed on O.D.S., if applicable. An employee whose illness commenced before the reduction of classification seniorityoperations and who has not yet completed the waiting period will receive disability insurance benefits as scheduled, subject to satisfying the requirements to establish disability under the benefit plan.
10.09.11 All insurance plans and benefits will continue in full force and effect during any period of O.D.S. and the employee's contribution to such plans and benefits will be collected by payroll deduction on their return to work. 12.07.10 Dispatch Employees may fully or partially liquidate time credits residing in their time bank as of the commencement of "off-duty status without pay". Such time bank liquidation requests are to be submitted to the Company in writing and may occur at any time during the "off-duty status without pay" period.
12.07.11 Undertime debits against gross earnings shall be the sum of all working days scheduled but not worked during the "off-duty status" period. Such determinations shall be based on the last Company published Flight Dispatch shift schedule prior to the Dispatch Employee being placed on "off-duty status without pay". At no time shall undertime debits for the period of a Dispatch Employee's "off-duty status without pay" exceed gross earning entitlements for that same period.
12.07.12 Company sick leave benefits will not be granted to Dispatch Employees on "off-duty status without pay". However, any illness during the period of "off-duty status without pay" may be reviewed at the Company Headquarters level upon request of the Association. However, Dispatch Employees who are in receipt of GDIP benefits will continue to receive such benefits until such benefits cease at which time they will be placed on “off-duty status without pay”.
12.07.13 Deductions for insurance premiums will continue to be made on any "full" or "part" pay cheque issued. However, when pay has ceased, the Company will arrange to have coverage continued. The premiums for such coverage will be deducted from pay cheques after a Dispatch Employee's return to work.
12.07.14 In off-duty status situations covered by this Article, Dispatch Employees will be provided, on a request basis, a one-time opportunity to elect voluntary "off-duty status without pay". Such requests will be approved by the Company; subject to operational requirements. Such requests for voluntary "off-duty status without pay" may not be changed regardless of the duration of the period of off-duty status. Such Dispatch Employees are also ineligible for short-term/temporary return to work assignments unless identified by the Company, as an operational requirement, and the Dispatch Employee must then return to work in accordance with instructions received.
12.07.15 Recognizing that classification"off-duty status without pay" is disruptive to all Dispatch Employees, prior to exercising the provisions of this article, the Company will consider alternative solutions that are economically viable.

.06 Where employees covered by this Agreement are An employee placed on "off- duty status without pay" other employees O.D.S. will not perform work that is normally done by employees of the bargaining uniteither commence their vacation as scheduled or alternatively, may elect to receive their vacation pay at a later date.

Off-Duty Status. .01 20.01 The Union acknowledges the Company's right to place employees on "offOff-duty status Duty Status without payPay" under circumstances where the Company discontinues all or part of its revenue operations due to an Act of God, national war emergency, revocation of the Company's operation certificates or certificate, strike, lockout or picketing of the Company's premises, grounding of a substantial number of Company aircraft or other circumstances over which the Company has no control.
.02 20.02 The General Chairperson Union will be informed of the Company's intention to place all or some employees on "offOff-duty status Duty Status without payPay" and the general handling of employees covered by the Agreement will be reviewed. At each location city where employees are affected, local Union representatives will be advised of detailed handling.
.03 20.03 Employees will be given a minimum of twenty-four (24) hours notice of intended action before being placed on "offOff-duty status Duty Status without payPay". Where such notice is verbal verbal, it will be subsequently confirmed in writing. In any event, "offOff-duty status Duty Status without payPay" will not commence until twenty-four (24) hours after cessation of service.
.04 20.04 Where employees are retained or returned to duty to perform required work, senior qualified the Company shall determine which job classifications shall be required and employees in those classifications within a work unit at a work location shall be assigned on the basis of classification seniority. Exceptions may If there is a Lead Customer Service Agent requirement then, subsequent to filling that requirement, the balance of the employees in the Lead Customer Service Agent classification shall be made where special skills integrated, in seniority sequence, with the employees in the basic classification for the duration of the Off-Duty Status period for determining the retention of staff or job continuity is requiredreturning to duty sequencing. In cases where it is decided to carry on scheduled training programs, those employees already involved shall be retained.
.05 20.05 All probationary and Part-Time employees within a work unit will be placed on Off-Duty Status before Full-Time employees.
20.06 During the Off-Duty Status period, the provisions of Articles 12.01.02 to 12.01.06, 12.01.08 and 12.01.10 shall be suspended. Where employees are retained or returned to duty during the Off-Duty Status period, shifts and days off may be adjusted and employees who work less than five (5) days in any seven (7) day period will not be scheduled for regular days off.
20.07 During an Off-Duty Status situation, Appendix "D", Shift Trades, shall be suspended for the duration of the Off-Duty Status period.
20.08 There shall be no overtime at a work unit where employees are on Off-Duty Status. Additional staff requirements shall be filled by returning employees from Off-Duty Status to duty in order of work unit seniority. During the Off-Duty Status period, local overtime distribution rules, as well as Appendix "C", Distribution of Overtime, will be suspended.
20.09 However, any overtime generated by functional or operational carryover will be permitted and will be worked by employees who have been retained and who are on shift. The resulting overtime worked will be added to the local overtime equalization procedures upon the termination of the Off-Duty Status period.
20.10 Employees who are on vacation at the time will continue on such vacation with pay for the dates of the actual vacation only and will be placed on Off-Duty Status upon the date of their scheduled return from vacation. Employees whose vacations are scheduled to start after or during Off-Duty Status will take such vacation with pay as scheduled. Such vacation will not be postponed or rescheduled.
20.11 An employee whose medical disability status has been approved by Air Canada Medical Services as provided for under Article 16.03, prior to the commencement of Off-Duty Status will continue to receive these benefits subject to Article 16.02.03, until he is scheduled to return to work, at which time he will be placed on Off-Duty Status, if applicable.
20.12 Notification of return to duty may be verbal but will subsequently be confirmed in writing. The Company will not discriminate against Union Members make every effort to return such employees to duty in order of seniority consistent with respect to clerical employees working in close relationship to employees covered by the Collective Agreement. This provision has no application to managerial, supervisory or confidential personnel in matters relating to labour relationstheir assigned work schedules.
