Office Space Not Timely Available. If we are unable to make the Office Space available by the Start Date we will not be subject to any liability related to such inability, nor will such inability affect the enforceability of this Agreement. This Agreement shall remain in full force and effect, provided that: (i) the failure to provide access to the Office Space does not last longer than two (2) months and (ii) at our sole discretion we will either (x) provide you with alternate office space (which may or may not be within a WeWork building) with reasonably comparable Capacity during such period and charge your Membership Fee or (y) not charge you the Membership Fee during the period the Office Space is not available to you. Following the two (2) month period set forth in (i) above, you shall have the ability to terminate this Agreement upon seven (7) days’ prior notice to us. If we do provide you alternate office space as described in clause (x) above, during the period we provide you with such alternate office space, the individuals named as Members shall be deemed to be Members and otherwise shall be fully subject to the terms of this Agreement. Notwithstanding anything in this paragraph to the contrary, if the delay in providing the Office Space is due to your actions or inactions or due to changes in or work to the Office Space requested by you, we will not be subject to any liability related to such delay nor will such delay affect the validity of this Agreement and we shall have no obligations to provide you with the benefits described in subsections (x) and (y) of this paragraph and you shall not be entitled to terminate this Agreement and shall be liable for the payment of the Membership Fees from the Start Date.
Office Space Not Timely Available. If we are unable to make the Office Space available by the Start Date for any reason, including due to (i) changes in construction plans, delays in obtaining permits, or any other obstacles in procuring space in any Premises, or (ii) delays caused by you or by changes requested by you, we will not be subject to any liability related to such inability, nor will such failure affect the validity of this Agreement. In this event, except as set forth in this Agreement, you will not be obligated to make payments of the Membership Fee until the Office Space is made available to you.
Office Space Not Timely Available. If we are unable to make the particular segment of the Space listed on your Initial Invoice available by the Start Date, Phase Two will attempt to provide you with an equivalent or superior location (at the same cost) and Phase Two shall relocate you to your designated segment once available. If the segment of the Space is not made available to you within 60 days of the Start Date, you may terminate this Agreement by providing us with notice of such termination at any time following the expiration of such 60-day period and before the segment of Space is made available to you. Upon timely notice of termination Phase Two will Immediately accept this notice of termination and refund any funds then owing.
Office Space Not Timely Available. If ARGO is unable to make the office space available to you when you have a Desk Surfing, ARGO will not be subject to any liability, nor will such failure affect the validity of this Agreement or entitle you to claim any charges or other amounts from ARGO.

If Mascots is unable to make the office space available by the Start Date, Mascots will not be subject to any liability therefore, nor will such failure affect the validity of this Agreement. In this event, you will not be obligated to make payments of the Membership fee until the office space is made available to you. If the office space is not made available to you within Ten days of the Start Date, you may terminate this Agreement by providing Mascots with notice of such termination at any time before the office space is made available to you. If you elect to terminate Membership under this provision, Mascots will refund to you all fees paid by you and received by Mascots.

If RAW is unable to make the office space available by the Start Date, RAW will not be subject to any liability therefore, nor will such failure affect the validity of this Agreement. In this event, you will not be obligated to make payments of the Membership fee until the office space is made available to you. If the office space is not made available to you within fifteen (15) days of the Start Date, you may terminate this Agreement by providing RAW with notice of such termination at any time before the office space is made available to you. If you elect to terminate Membership under this provision, RAW will refund to you all fees paid by you and received by RAW.

In this event, you will not be obligated to make payments of the Membership fee until the office space is made available to you. If the office space is not made available to you within fifteen (15) days of the Start Date, you may terminate this Agreement by providing TWV with notice of such termination at any time before the office space is made available to you. If you elect to terminate Membership under this provision, TWV will refund to you all fees paid by you and received by TWV.

If we are unable to make the Office Space available by the Start Date for any reason, including due to changes in construction plans, delays in obtaining permits, or any other obstacles in procuring space in any Premises, we will notify you of any such circumstances and we will not be subject to any liability related to such inability, nor will such failure affect the validity of this Agreement which shall remain in full force and effect. In this event, except as set forth in this Agreement, you will not be obligated to make payments of the Monthly Fee until the Office Space is made available to you. Notwithstanding the foregoing, if we are unable to make the Office Space available by the Start Date due to delays caused by your actions or inactions or due to changes in work or other customizations to the Office Space requested by you, we will not be subject to any liability related to such delay nor will such delay affect the validity of this Agreement, you shall not be entitled to terminate this Agreement and you shall be responsible for the payment of the Monthly Fees from the Start Date.
