OPERATIONAL MEASUREMENTS. Seller will establish the general condition of the system in terms of performance benchmarks that can be used to evaluate historical and ongoing performance improvement or changes. The system performance baseline will be established by Seller evaluating the Buyer provided switch performance related to operational measurements ("OM") maintained on the switch. Customer is required to provide remote access to the Switch database to permit table set-up and data collection. OM will be set-up and monitored by a member of the Seller deployment team at least one week prior to the arrival of the RF Engineering evaluation team to evaluate the existing system performance metrics and establish a baseline prior to performance of applicable optimization Services; provided Buyer purchases such Seller optimization Services. The OM will be monitored during the deployment process and for at least one week after such team leaves the market. This is to ensure that any performance enhancements can be verified, and further serves to establish the new System performance baseline.

OPERATIONAL MEASUREMENTS. This Section sets forth qualitative descriptions of the Operational Measurements (OMs). The business objectives and commencement of obligations associated with such Operational Measurements are set forth in Attachment 3-A (Service Level Matrix) and shall be documented and updated in the Service Management Manual. The MSI and Service Provider will acknowledge and agree that the MSI will assist and coordinate the delivery of Services to DIR and Customers. Similarly, the MSI will report the Operational Measures defined below based on information collected by the MSI through the MSI provided systems and processes as defined in the Service Management Manual (SMM) and through data provided by the Successful Respondent to the MSI for reporting purposes.
OPERATIONAL MEASUREMENTS. 11.1 To provide an ongoing substantive measurement of progress towards objectives which the North Central CMA and its employees are committed to through the intent of this agreement, a number of Key Performance Indicators have been selected for periodic review by the Staff Consultative Committee (See Appendix B – Key Performance Indicators).

  • Measurement Should the State terminate this contract as herein provided, no fees other than fees due and payable at the time of termination shall thereafter be paid to the Engineer. In determining the value of the work performed by the Engineer prior to termination, the State shall be the sole judge. Compensation for work at termination will be based on a percentage of the work completed at that time. Should the State terminate this contract under paragraph (4) or (5) above, the Engineer shall not incur costs during the thirty-day notice period in excess of the amount incurred during the preceding thirty days.

Provided further, nothing contained herein shall absolve the Affected Party from any payment obligations accrued prior to the occurrence of the underlying Force Majeure Event.

  • Goals Goals define availability, performance and other objectives of Service provisioning and delivery. Goals do not include remedies and failure to meet any Service Goal does not entitle Customer to a Service credit.

  • Performance Standards The Contractor agrees to perform all tasks and provide deliverables as set forth in the Contract. The Department and the Customer will be entitled at all times, upon request, to be advised as to the status of work being done by the Contractor and of the details thereof.
