Common use of Opt-Outs Clause in Contracts

Opt-Outs. (a) A Potential Settlement Class Member who wishes to exclude himself or herself from this Agreement, and from the release of claims and defenses provided for under the terms of this Agreement, shall submit an Exclusion Letter by mail to the Settlement Administrator. For an Exclusion Letter to be valid, it must be postmarked on or before the Bar Date to Opt-Out. Any Exclusion Letter shall identify the Potential Settlement Class Member, state that the Potential Settlement Class Member wishes to be excluded from the Agreement, and shall be signed and dated.
