Our Rights. You acknowledge that We are not obligated to use Your Contribution as part of the Material and may decide to include any Contribution We consider appropriate.
Our Rights. Alterations and building works We have the right to carry out any alterations or building works at the Accommodation, the Building without liability for disturbance provided that, as far as practicable, we have used reasonable endeavours to minimise disturbance.
Our Rights. We will at all times during the Residency Period (and any holding over period) keep possession of, and full control over, the Building and will at all times have full and free access for such purposes as We may consider appropriate.
Our Rights. If we decide not to exercise a right, remedy or power, this does not mean it cannot be exercised later. In addition, we are not liable for any loss caused by exercising or attempting to exercise a right, remedy or power or by not exercising it.
Our Rights. Subject to the provisions of Clause 22.1 above, non- market Orders may be cancelled via the Electronic Trading System. We can only cancel your orders if you explicitly request so, and provided that we have not acted up to the time of your request upon those instructions. Executed instructions may only be withdrawn or amended by you with our consent. We shall have no liability for any claims, losses, damages, costs or expenses, including legal fees, arising directly or indirectly out of the failure of such order to be cancelled.
Our Rights. Whenever this Agreement provides that we have a certain right, that right is absolute and the parties intend that our exercise of that right will not be subject to any limitation or review. We have the right to operate, administrate, develop, and change the System in any manner that is not specifically precluded by the provisions of this Agreement, although this right does not modify the requirements of subparagraph 5.E and other express limitations set forth in this Agreement.
Our Rights. If we pay a claim contrary to this policy’s terms and conditions, that payment does not waive our rights to apply those terms and conditions to any paid or any future claim. We also have the right to recover from you any claim amount incorrectly paid.
Our Rights. Nothing in this clause affects any rights that either of us may have against the other.
Our Rights. We shall not be bound to accept any renewal of this policy and may at any time give twenty one (21) days notice of cancellation by recorded delivery to your last known address. You shall be entitled to the return of a proportionate part of the premium paid in respect of the unexpired term of this policy provided that there have been:
a) no claims made under the policy for which we have made a payment;
b) no claims made under the policy which are still under consideration;
c) no incident likely to give rise to a claim but is yet to be reported to us; during the current period of insurance This termination will be without prejudice to your or our rights or claims incurred prior to the expiration of such notice. If a claim has been submitted or there has been any incident likely to give rise to a claim during the current period of insurance no refund for the unexpired portion of the premium will be given.
Our Rights. If we fail to cancel or stop any funds transfer, the payment will stand unless you show us that payment to the payee was unenforceable. If we recredit your account after transferring funds over a valid and timely cancellation request, you agree to sign a statement describing the dispute with the payee, to transfer to us all of your rights against the payee, and to assist us in any legal action taken against that person.
