OUTBOUND MARKETING. All outbound marketing content including all electronic communication with End Users who are not Intraware Customers will be approved by Netscape. The parties will mutually agree upon the guidelines for marketing materials, as set forth in the Statement of Work.

OUTBOUND MARKETING. Home will use reasonable efforts with its Distribution Affiliates to include Travelocity in any content-related external marketing pieces. Any such marketing pieces in which @Home chooses to include Travelocity will, at a minimum, include the Travelocity name but may also include the Travelocity logo, descriptions, screen shots, etc. TSG will provide, and @Home will comply with, guidelines for how to describe/display Travelocity in @Home outbound marketing efforts. Possible marketing avenues may include, but are not limited to, cable TV spots/infomercials, newspaper ads, bill xxxffers, postcards, door hangers, direct mail, and take-one brochures. TSG shall have the right of prior approval of any mention or representation of TSG in any such marketing materials. @Home shall include TSG in its 30 minute `informercial' to be shot on or about March 13, 1998.

Subject to XxXxxx.xxx's pre-approval, XxXxxx.xxx will provide @Home with guidelines for how to describe/display XxXxxx.xxx in @Home outbound marketing efforts.

  • Sales and Marketing Subdistributor shall market, promote, and solicit orders for the Products to prospective and existing Customers (excluding the Excluded Customers) consistent with good business practice and the highest professional standards in the industry, in each case using its best efforts to maximize Product sales volume in the Territory in accordance with Distributor’s Product marketing strategies, channel and pricing guidelines, and sales policies, and in a manner that reflects favorably at all times on the Products and the good name, goodwill, and reputation of Distributor;

  • Promotion and Marketing For the purpose of promotion and marketing, the Borrower hereby authorizes and consents to the reproduction, disclosure and use by the Lenders and the Agent of its name, identifying logo and the Facilities.   • Customer Service As between Fig and Developer, Developer shall be solely responsible for providing and maintaining customer service and technical support in the Territory to Distributors and end users with respect to the Licensed Game (including, for the avoidance of doubt, any Distributors and end-users of Fig pursuant to Fig Sales (as defined below)). Such customer service and technical support shall be of a quality that is comparable to such customer service and technical support as Developer provides for its other “top-tier” titles. For the purposes of this Section, “customer service” means the resolution of issues pertaining to the Licensed Game in the following general categories: payment processing, order inquiries, replacements and refunds, and technical support.

  • Computer Files Marked The Seller shall, at its own expense, on or before the Closing Date, indicate in its computer files that the Receivables have been sold to the Purchaser pursuant to this Receivables Purchase Agreement and deliver to the Purchaser the Receivable Schedule, certified by an officer of the Seller to be true, correct and complete.
