Over-shipment. Contractual Goods (herein, “Goods”) shall not be supplied in excess of quantities and shipping tolerances, if any, specified in the Contract. Seller shall be liable for handling charges and return shipment costs for any excess quantities, and unless Seller agrees to pay for such costs, the over shipped material will be retained by Buyer at no cost.

Over-shipment. All over-shipments made are the seller’s responsibility. The purchaser reserves the right to reject and return, at the seller’s expense, any goods in excess of the quantity ordered.

Over-shipment. If OLYMPUS finds an over-shipment of Product units, OLYMPUS may store or return the excess Product units to VENDOR, both at VENDOR's risk and expense. If OLYMPUS decides to retain such excess, OLYMPUS shall increase the purchase amount specified in the related purchase order accordingly .
Over-shipment. Over-shipment of material not approved by Buyer in writing and in advance will be returned at Seller’s expense, if such over- shipment exceeds 10% of the total ordered quantity per line, or the excess cost of such over-shipment is more than $500 US, whichever is smaller; unless negotiated differently in a specific supplier contract in force.

SELLER shall mark containers or packages with necessary lifting, loading, and shipping information, including the LOCKHEED XXXXXX Contract number, item number, dates of shipment, and the names and addresses of consignor and consignee. Bills of lading shall include this Contract number. (c) Unless otherwise specified, delivery shall be FOB Place of Shipment.

  • Packaging and Shipping All shipping containers shall be packed and packaged to: (i) ensure safe arrival to final destination; (ii) secure the lowest transportation costs;(iii) comply with requirements of common carriers; (iv) meet Buyer's written instructions; and (v) meet the requirements of all applicable laws, ordinances, rules and regulations.

  • Shipment Dell will ship the APEX System to the Site when included as part of the APEX Service. The terms and process for shipment and delivery of the APEX System will be stated in the applicable Service Offering Description.

Seller shall provide and convey to Buyer the Power Product from the Generating Facility at the Delivery Point. Title to and risk of loss related to the Power Product transfer from Seller to Buyer at the Delivery Point.

  • Interconnection Customer Provided Services The services provided by Interconnection Customer under this LGIA are set forth in Article 9.6 and Article 13.5. 1. Interconnection Customer shall be paid for such services in accordance with Article 11.6.

  • Delivery Points ‌ Project water made available to the Agency pursuant to Article 6 shall be delivered to the Agency by the State at the delivery structures established in accordance with Article 10.
