OVERDRAFT PROTECTION. If I wish Overdraft Protection I understand I must apply and be approved for it. Every account does not come with the member is enrolled in Overdraft Protection, the provisions of this Section G will apply:
1. If I have been approved for Overdraft Protection with my account, I can borrow up to The maximum amount by which the limit member may overdraw the account will initially be set by the Servus Credit Union (the “Overdraft Limit”) and may be increased with the member’s approval or the approval of any other person liable for the account as described in Section C.12. Servus Credit Union may decrease the overdraft limit at any time and for any reason.
2. Servus Credit Union may debit the account in the amount of any cheque or withdrawal, or other item drawn on the account, and interest, as provided in this Section G. Servus Credit Union may refuse to pay any cheque, withdrawal or any other item drawn on the account if the outstanding debit balance of the account exceeds, or would after payment of such cheque, withdrawal or other item, exceed the overdraft limit on the date such cheque, withdrawal or other item is presented to Servus Credit Union for payment.
3. The member will pay on demand all amounts which overdraw the account and will pay interest, both before and after demand, on all amounts which overdraw the account, calculated from the date each amount is debited to the account until the date of payment at a rate and on terms that Servus Credit Union may from time to time establish. The rate and terms may be obtained at any branch of Servus Credit Union and the current rate, along with the overdraft limit, will be shown on the member’s Statement of Account. Interest shall be calculated daily but is payable monthly both before and after demand, default, and judgment. Overdue interest shall be compounded monthly.
4. In addition to interest payable under Section G.3., the member agrees to pay to Servus Credit Union any costs of administration that relate to transactions that overdraw or increase the amount overdrawn on the account (the “Transaction Fee”) as well as those costs that relate to maintaining the overdraft limit (the “Standby Fee”). The transaction fees and standby fees may change from time to time and the current transaction fee and standby fee may be ascertained from Servus Credit Union. The transaction fees and standby fees may be debited to the account and any such fees charged will be reflected on the Statement of Account pertaining to the account.
5. The member hereby pledges to Servus Credit Union all deposits and shares which the member now or may have in Servus Credit Union, the proceeds of which may, upon default of the member’s obligations with respect to overdraft, be applied by Servus Credit Union to any overdraft amounts due and owing. This pledge is in addition to any other rights of or security held by Servus Credit Union regarding the member’s overdraft obligations.
6. Either the member or Servus Credit Union may change the Limit or terminate end the Overdraft Protection at any time, at its sole discretion, on time by providing notice to methe other in accordance with J.16. Once terminated, but ending Overdraft Protection is will have no longer available to me. I can use the Overdraft Protection if there are not enough funds in my account(s) to cover a cheque or other debit item I have authorized or a withdrawal I have made up to the Limit. I may access the Overdraft Protection by writing cheques or by any other debit transaction I initiate all of which shall be considered an advance or loan to me. All deposits or credits to my account or a linked deposit account to which the Overdraft Protection is attached will constitute a payment impact on the Overdraft Protection and member’s obligation to repay the overdraft amount owing. In addition, if (a) the member fails to make any payment in accordance with this agreement or otherwise breaches this agreement, (b) the member dies, (c) the member becomes subject to or takes advantage of any law relating to bankruptcy or insolvency or for the purposes relief of The Personal Property Security Act shall constitute a debtor initiated payment. I will pay debtors, or (d) upon attachment, execution or levy against the Credit Union interest on all amounts advanced up to member or the Limit from the date of the advancemember’s property, as well after as before maturity, default or judgment at the rate of interest charged by you from time to time for Overdraft Protection and any Overdraft Protection charges established by the Credit Union from time to time. If not paid, the then Servus Credit Union may advance on immediately and without notice to the Overdraft Protection to pay such interest. I agree to pay the amount owing on the Overdraft Protection including interest Upon Demand by the Credit Union. If I default on payment, I agree to pay the charges applicable to Overdraft Protection. If I overdraw the approved Overdraft Protection Limit or if there is no Overdraft Protection on my account I promise to pay upon your request any amounts that overdraw my account(s)(“an overdraft”) which you in your absolute discretion may permit together with interest on such overdraft at the interest rate charged by you from time to time and any overdraft charges established by the Credit Union from time to time. The Credit Union Limit applicable to your credit card Account from time to time pursuant to this Agreement will not be increased or expanded because of Overdraft Advances. By participating in the Overdraft Protection coverage, you acknowledge and agree to the following: (i) the privileges attached to this Overdraft Protection coverage are contingent upon you maintaining and properly handling both the Deposit Account and the credit card Account; (ii) the Overdraft Protection will immediately terminate upon the closing of either the credit card Account or the Deposit Account for any reason; (iii) we may change review the Limit Account involved in this Agreement and, upon a finding of any misuse, fraudulent behavior, or violation of the terms of this Agreement, we may withdraw any Overdraft Protection coverage or suspend your use of the Card or other credit extended under your Account; (iv) it is possible that an Overdraft Advance may result in creating a credit card Account balance in excess of your approved Credit Limit, or exceeding the available credit under any lower limit you may assign to your credit card Account (which also applies to Overdraft Advances), which may cause Purchase or Cash Advance transactions with your Card to be declined. If your Account is approaching the designated timeframe to be escheated, we will mail you a notice at the address we have on file for you as required by law. You may establish a sequence different from that described above for the transfer of available funds to cover overdrafts by contacting us at 800-328-5328. We may but shall not be required to pay overdrafts by any of these means. All Overdraft Protection advances from a Logix Credit Card or ReadyLine of Credit, and funds transfers from a Logix savings account, will be made in $100 increments. Should your Logix Credit Card, ReadyLine of Credit or savings account not contain the required $100 increment we will advance any available credit or transfer any available savings account funds (we may also advance/transfer funds from more than one source – i.e. advance funds from your Logix Credit Union Card and transfer funds from your Logix savings account to cover the item); however, if sufficient credit is not available, even when aggregating the funds available through all sources (i.e., your Logix Credit Card or ReadyLine of Credit and your Logix savings account), to cover the “Limit”amount of the check, ACH payment, or other item, we will be unable to initiate the advance or transfer, and the check, ACH payment or other item may be returned unpaid. Overdraft Protection advances and transfers from your credit and savings accounts are made only from the credit and savings accounts maintained on the same membership account number in which the related checking account overdraft occurs, and are initiated in the following hierarchical sequence order (if you do not have one of the listed accounts we will look to the next stated account in sequence): (a) your oldest/earliest established Logix Credit Card; (b) your ReadyLine of Credit; (c) your main savings and other savings account(s); and, (d) your newest/latest established Logix Credit Card. The Credit Union Advances and transfers may occur from multiple credit and savings accounts in order to cover the checking account overdraft. You can change the Limit hierarchical sequence order of your Overdraft Protection advances and funds transfers by calling us at 0- 000-000-0000. If we advance funds from your Logix Credit Card or terminate ReadyLine of Credit or we transfer funds from your Logix savings account to cover an overdraft, then we will assess an Overdraft Protection Transfer Fee and charge this fee to your Logix checking account. Note that no Overdraft Protection Transfer Fee will apply to overdrafts arising from a transaction that was authorized with a sufficient available balance, even if the available balance is insufficient at the time of the transaction posting. If a credit is subsequently given for a transaction and has a different central processing date, then the exchange rate of the credit may be greater or less than that of the original transaction. You agree to accept the converted amount in U.S. Dollars. In addition, if you use your Card and PIN to obtain a Cash Advance at an ATM that involves a multi-national or worldwide automated teller machine network switch and involves a currency other than U.S. Dollars, the transaction will be converted to U.S. Dollars, generally using either (1) a government-mandated rate, or (2) a wholesale market rate in effect the day before the transaction processing date. The currency conversion rate used on the processing date may differ from the rate in effect at the time of the transaction or on the date the transaction is posted to your account. Refusal To Authorize Transactions We may, but are not required to, decline a transaction on the account and/or cardholder’s account because of operational considerations, because the account and/or a cardholder’s account is in default under this agreement, to protect against potential fraudulent or unlawful activity, circumstances that suggest fraud, authorization facilities are not functioning or in our discretion, for any other reason. Should a transaction on the account and/or cardholder’s account be declined either by us or a third party, even if you have sufficient credit available, we will not be responsible for any losses that may result. For online transactions, if fraud is suspected, you or a cardholder might be asked to call the phone number on the back of the Card to confirm the transaction. Loss, Theft Or Unauthorized Use If you are an organization with ten (10) or more employees and we have issued ten (10) or more Cards on the account for use by cardholders, you agree that: (i) all transactions conducted by one of your owners, by the cardholder or a person authorized by the cardholder or any person with an interest in or authority to transact business on the account will conclusively be deemed to be an authorized transaction; and, (ii) you will be liable for any unauthorized use of a Card or the account before you give written notification to us if we reasonably determine, based on substantial evidence, that the cardholder was grossly negligent in the handling of the account or Card. You will inform us immediately by telephone and in writing about any actual or suspected loss, theft or unauthorized use of a Card, account number, PIN or Convenience Check. Notify us in writing at CEFCU, P.O. Box 1715, Peoria, Illinois 00000-0000 and by phone at 0.000.000.0000, of the loss, theft or possible unauthorized use. You agree that we will consider that all transactions have been authorized by you until you advise us otherwise. After notification to us, you will not be liable for unauthorized use of the Card. Ownership Of Card You agree that the Card remains the property of CEFCU and will be surrendered to CEFCU on demand; and, that you do not have the right to assign or transfer from your rights and obligations under this agreement, the account, cardholder account(s) or any of my accounts including Card to anyone else. Observing The Card’s Expiration Date If the Card contains an expiration date, you and each cardholder agree not to use it or any joint account Convenience Checks after such funds as expiration date. If they are necessary used, you agree to pay any such overdraftdebts that are incurred. ATMs The Overdraft Protection rate availability of ATM services and the Cash Advance amount a cardholder can withdraw each day may vary from time to time and without prior notice to you. When both a designated deposit Account and a designated Overdraft Line of Credit Account are linked, the balance in either Account must be sufficient to cover the overdraft in full before a transfer can be made. The balances in the different Accounts will not be combined to cover the overdraft. Overdraft Line of Credit Accounts are subject to qualification and the terms and conditions contained in the applicable credit agreement, please refer to the Overdraft Line of Credit Agreement for more information. If you do not have sufficient funds in your savings account, then we may, subject to the conditions described below, pay the overdraft item on your behalf. This is known as the Logix Courtesy Pay program. If not paid, the Credit Union may advance on the Overdraft Protection to pay such interest. Each such cash advance (an “Overdraft Advance”) must be repaid as a part of your total indebtedness under this Agreement with all applicable Finance Charges. The Credit Union Limit applicable to your credit card Account from time to time pursuant to this Agreement will not be increased or expanded because of Overdraft Advances.
