Discretionary Service. Under the Overdraft Service, we are not obligated to pay any check or item presented for payment if your account does not contain sufficient funds. We may, as a discretionary service and not as a right of yours or our obligation to you, pay overdrafts up to an approved overdraft limit under the terms of this service and subject to this Agreement. This overdraft service is not a line of credit, is not guaranteed, and is independent of any loan arrangement you may have with us. We will not pay an overdraft for you in excess of any limit we have established for your account type. Also, we may refuse to pay an overdraft for you at any time, even if we have previously paid overdrafts for you.

Discretionary Service. Overdraft Protection is not a loan or a line of credit. Even if you have opted in to Overdraft Protection, we are not obligated to pay any Card purchase transaction presented for payment that exceeds the Available Balance of your account. Payment of such transactions by us is a discretionary, non-contractual courtesy and not a right of yours or an obligation of ours. Any discretionary payment by us of any overdraft transaction does not obligate us to pay any other overdraft transaction. We, in our sole and absolute discretion, may cease paying overdraft transactions at any time without prior notice of reason or cause.

For all other overdraft transactions, Courtesy Pay will be provided automatically once a checking account has been opened and qualified for the service and will continue as long as the account is maintained in good standing with the Credit Union. Under Courtesy Pay, we are not obligated to pay any check or item presented for payment if your account does not contain sufficient funds. The Credit Union may, as a discretionary service and not as a right of yours or our obligation to you, pay overdrafts up to an approved overdraft limit under the terms of Courtesy Pay and subject to this Agreement. Via your mailed (or e-mailed, if you have so requested) periodic statement, we will notify you of any insufficient funds, checks, or items paid or unpaid and returned that you may have. However, we have no obligation to notify you before we pay or return any item.

Overdraft Privilege is provided to qualified accounts automatically for checks; ACH; Home Banking 24 and Mobile Banking 24 transactions; ATM and debit card transactions will be provided for only if you request Overdraft Privilege by expressly requesting these transactions (“opt-in”). To be eligible for Overdraft Privilege you must satisfy the following conditions: keep a positive balance in your account at least once every 30 days; you must not be more that 14 days past due on any loan or delinquent on any other obligation with the Credit Union or subject to any legal order, levy or bankruptcy proceeding; you must not have an outstanding balance on an Overdraft Repayment Plan; you must not be subject to a ChexSystems or other negative indicator or an extended hold on your checking account or any other account relationship with us. Overdraft Privilege is not available to minors, dormant accounts, Debit Card Checking, POD, Fiduciary or Escrow accounts. Under the Overdraft Privilege service, we are not obligated to pay any check or item presented for payment if your account does not contain sufficient funds. We may, as a discretionary service and not as a right of yours or our obligation to you, pay overdrafts up to an approved overdraft limit under the terms of this service and subject to this Agreement. This Overdraft Privilege service is not a line of credit, is not guaranteed, and is independent of any loan arrangement you may have with us.
