Section 5 An employee covered by this Collective Agreement shall receive pay for the following Statutory Holidays when not worked, provided they worked their last scheduled shift previous and their next scheduled shift following such Holiday, reasonable lateness accepted, unless permission to be off has been granted by management. Section 6 Employees required to work on these days shall receive double their regular rate of pay, plus one day's pay for the Holiday. Section 8 An employee shall not be eligible for payment of a Holiday if they are on leave of absence, Workers' compensation, sickness or long-term disability benefits at the time the Holiday falls due. Section 9 The period of time recognized as a Holiday is the twenty-four (24) hour period beginning at the starting time of the regular shift on the day which is recognized a Holiday. Section 10 Where there are two (2) shifts employed, each shift shall work one-half (1/2) of their regular shift consecutively only on Christmas Eve Day (December 24th) and New Year's Eve Day (December 31st) in order to avoid the necessity of working until midnight. Other arrangements may be made by mutual agreement. Each shift shall receive pay for the hours worked. Section 11 The Employer will agree to post the Christmas holiday schedule by November 30th of each year. Statutory Holidays shall be recognized on their calendar dates unless otherwise agreed to. The Employer six month periods shall notify be January 1 to June 30 and July 1 to December 31 commencing January 1, 2007. The pro-ration formula to be used is a follows: (# of Hours Worked in a six month period divided by 1040) x (# of Paid Holidays) x (Regular Rate of Pay x 8 hours) = Holiday Pay. In addition to the employees twentystatutory holiday pay stated above, permanent part time Head Lifeguards who do not work the statutory holiday, will be paid for their full shift and any overpayment shall be recovered from the semi-four (24) hours in advance for weekly annual payment noted above. Employees shall accept additional shifts and overtime work. For Provided the purposes requirements of overtimethe service are met the Employer or its designated representative shall grant requests by individual employees to be excused from additional shifts and overtime work. In the event the number of employees required in each classification exceeds the number of requests to be excused, requests in each classification shall be granted on the basis of seniority. Employees shall be ready for additional shifts and overtime work at a specified time when given an advance notice of such additional shifts and overtime work by their supervisors. The Junior employee(s) shall be granted one refusal per shift schedule. Should the junior employee refuse to accept additional or overtime shifts a second time during any shift schedule, the week shall be defined as Monday to Sunday for the first (1st) and second (2nd) shift, and Sunday evening to Sunday for the third (3rd) shift.

Section 6 Employees (b) All hours worked in excess of the regular scheduled hours, Monday to Friday inclusive, shall be paid at one and one half (1 1/2) times the regular pay.
6:02 Overtime, shall be paid at the rate of double (2) time the employee’s basic hourly rate for all hours worked on Sunday.
6:03 There shall be no pyramiding or duplication of premium or additional pay. If an employee is called back to work by the immediate supervisor after normal work hours for any maintenance and repair services requested by a customer, and if such work function is less than two (2) hours, the employee shall be reimbursed for a minimum of two (2) hours.
